CALEA Commissioner A. DeWade Langley recently became the chairman and director of the University of Central Oklahoma's new School of Criminal Justice. Prior to accepting the position at the university, Commissioner Langley was the Director of the Oklahoma State Bureau of Investigation, a position he held since 1995, longer than any director in the history of the agency. Oklahoma State Bureau of Investigation is a CALEA Accredited Agency since July 2002. Congratulations and best wishes to Commissioner Langley are in order as he takes advantage of new opportunities.

CALEA has posted the names of the Flagship Agencies honored at the Summer CALEA Conference. The CALEA Flagship Agency Program is designed to acknowledge CALEA Accredited public safety agencies that have demonstrated success in the accreditation process. The program also serves to provide other agencies seeking accreditation with examples of "best practices" on how to address compliance, policy development, file maintenance, and other issues relating to the accreditation process. Program Managers' Corner This is the seventeenth in a series of short articles from your CALEA Program Managers.
In the Absence of Controlling Legislation
During the March 2010 CALEA Conference, the Standards Review and Interpretation Committee (SRIC) considered the impact of the phrase "In the absence of controlling legislation..." on standards across all programs. During the respective research, it was discovered this language was used 19 times in the active standards. During further discussions, it was determined the phrase was having unintended consequences in the application of the affected standards, whereas some agencies used legislation to classify the standards as not applicable, while others simply classified the standard as in compliance with or without meeting all of the standards' components. The Commission has always intended these standards to be met by awarded agencies and for agencies to only use controlling legislation to serve as the binding directive or as documentation preventing compliance. And where legislation is silent on specific standards' requirements, the Commission had intended agencies to develop policy or practice to address the standards completely.
Given the complexity of this issue the SRIC acted to remove the language from all but one standard in each of the programs. The phrase has remained in the standards addressing probationary periods for newly promoted employees. Specifically, Law Enforcement Standard 32.2.10, Public Safety Communications Standard 4.3.11 and Public Safety Training Academy Standard 5.3.2 retained the language. Additionally, the phrase "collective bargaining agreement" was added to these standards to allow for labor contract issues that affect an agency's ability to impose probationary periods on newly hired employees. These actions were taken to ensure the standards were meeting the intentions of the Commission, while not detracting from participating agencies' ability to demonstrate compliance.
In the program standards addressing probationary status for newly promoted employees, the controlling legislation language is no longer used. These standards include Law Enforcement Standard 34.1.7, Public Safety Communications Standard 4.4.7 and Public Safety Training Academy Standard 5.4.6. These standards now require at least a six month probationary period for employees promoted (sworn employees only within the Standards for Law Enforcement Agencies), with "exceptions defined". Therefore, agencies should now critically review this standard in concert with promotional policies. Although the standard allows for exceptions for such issues as those positions that are considered appointments or other limited positions that are defined in policy, it does not allow for this standard to simply be addressed by listing all positions as exceptions. Furthermore, these standards are mandatory for all agencies in all programs.

Mutual Aid Agreements
2.1.3 The agency has written agreements with neighboring agencies to provide mutual aid in emergency situations. The mutual aid agreement must include, at a minimum, the following details:
|
a. |
the legal status of agencies and agency personnel responding to mutual aid requests; | |
b. |
procedures for vesting provider agency personnel with the legal authority to act within the receiver agency's jurisdiction; | |
c. |
procedures for requesting mutual aid; | |
d. |
identity of those persons authorized to request mutual aid; | |
e. |
identity of persons to whom outside personnel are to report; | |
f. |
procedures for maintaining radio communication with outside personnel; | |
g. |
expenditures, if any, which should be borne by the receiver agency to compensate for the use of the provider agency's resources; and | |
h. |
procedures for review and revision if prescribed in the agreement. |
Commentary: Emergency situations often require augmented law enforcement capabilities to restore order or assist victims. The agency's mutual aid agreement should provide all the information necessary to initiate mutual aid activities either on behalf of the agency or at the request of a neighboring law enforcement agency. The agreement should also consider provisions for the indemnification of the provider agency and its personnel, e.g., life, health, and liability insurance.
Whether the agency operates under existing legislation or a mutual aid agreement, it should have a plan for providing or receiving aid in critical incident situations. The plan should assess the extent of aid that could be provided while maintaining adequate law enforcement coverage in the service area. The types and amounts of major resources should be estimated and their locations listed. Planning should also involve liaison with other agencies (non-government organizations (NGO), social service organizations, institutions of higher education, school districts, medical facilities, and private entities) that may be involved when mutual aid is invoked. Effective March 2010 the Commission revised Standards for Law Enforcement Agencies - Standard 2.1.3, removing the language "In the absence of controlling legislation." Agencies that previously carried the standard as Not Applicable by Function because of controlling legislation should review this standard carefully prior to the next assessment. Agencies will no longer have the option of classifying the standard as Not Applicable by Function because of the existence of such legislation. If the respective state law(s) does not meet all the bullets in Standard 2.1.3 compliance may be achieved by coupling existing legislation with internal directives. CALEA agencies should also consider which neighboring agencies would likely be able to enter into such agreements. And, agency representatives are reminded that this is an "other-than-mandatory" standard.
There has been some concern expressed by limited numbers of agencies, particularly campus police having statewide jurisdiction or agencies located in metropolitan areas, that future assessment teams might decide an agency must have mutual aid agreements with all neighboring agencies before compliance is achieved. It should be noted, there is no intent for this to be the case. The intent of the standard is for the agency to consider mutual aid agreements in its overall emergency management planning.
Neighboring law enforcement agencies and non-governmental organizations can be valuable assets in times of emergencies that exceed the capacity of the primary agency to respond. The agency should consider entering into mutual aid agreements with neighboring agencies that are likely to enhance the agency's capacity in its overall emergency management planning. While the standard states "agencies" and "agreements" (plural), there is no requirement stated in the standard to have an agency enter into agreements with all contiguous jurisdictions or a specified number of neighboring agencies within a specific geographic area. The agency does have some latitude in deciding which nearby agencies complement its emergency planning and mutual aid efforts. |

ATTENTION CALEA CLIENTS
CALEA has been actively involved in a strategic planning process that has resulted in several new initiatives. These initiatives will likely have direct impacts on future training for assessors and team leaders. Subsequently, the new assessor and team leader training classes have been suspended until the special projects are completed. This will reduce any retraining that may be necessary as a result of the strategic initiatives CALEA is currently undertaking. We anticipate new assessor and team leader training to resume in 2011.

Re-Engineering the CALEA Accreditation
As a part of CALEA's strategic planning initiative and in response to listening to client suggestions, CALEA has been working diligently for the past eight months to re-engineer the reaccreditation process. A focus group of practitioners that included CEOs, active team leaders and assessors, accreditation managers, and PAC representation was assembled in the form of an Ad Hoc Committee. The group has met several times at CALEA headquarters and via teleconferencing since the beginning of 2010. A proposed new process for reaccreditation on-sites was presented to the full Commission at the Las Vegas Conference. The Commission was very excited about the proposal and approved the release of it to CALEA clients for feedback. Please review the proposal and provide feedback by 9/30/2010.
