Dear Members, Can you believe that 2011 is just a couple of months away? With the end of the year in sight, it's time to plan for 2011! Your membership renewal will be mailed in mid-November so be sure to budget your membership for next year. Thank you for your support and participation this year, there have been many things accomplished this year for the industry and your membership strengthens NUCA of NM and allows us to carry out our mission to Promote Protect and Preserve the Utility Industry. Don't forget to fax your 2011 Ballot to the association office as Monday, November 1, 2010 is the last day to submit the ballot. (FAX 505 884 0668) There are two major events before the end of the year. The regularly scheduled Membership Meeting in October was re-scheduled for November 11, 2010 11:30am - 1:00pm at the Albuquerque Country Club. Carla Sonntag, NUCA of NM Lobbyist, will present a wrap-up of the 2010 mid-term election and will also preview what's coming for the 60 day NM Legislative Session. Your membership dues help pay for your local representation in Santa Fe and also representation in Washington DC. Politics - love it or hate it but you must have a voice and NUCA and NUCA of NM speak up for you! On December 9, 2010 6pm, we'll be having the Annual End-Of-Year-Social where we will have food, drink, and good company! This is the perfect opportunity to visit with friends and colleagues in a relaxed atmosphere. Terri Baker, HD Supply, will be leaving the Board this year so we will acknowledge her service and also welcome in the new 2011 Board. This year, we are planning a silent auction to raise money for legislative efforts. The event will take place at one of the best views in the city at the base of the tram at Sandiagos Restaurant; if you feel like venturing up to the top of the mountain, tickets will be offered for only $10 (round trip of course). NUCA "Lame Duck" Fly-In to Address Top Priorities
On Wednesday, Nov. 17, NUCA's Government Relations and Political Action Committee will meet on Capitol Hill, and quite frankly, your association needs you there. While the agenda will include general committee business, visits to Capitol Hill offices will also be included for a strong albeit brief push for several legislative priorities that very well could be considered during next month's "lame duck" session of Congress.
Lawmakers return to Washington the week of Nov. 15, when the first order of business will be to complete and vote on the remaining FY2011 appropriations bills, most likely in a large "omnibus" appropriations measure. Traditionally, not much else happens during a lame duck session, but this year consideration of a "tax extenders" package is expected, and we have a lot at stake. The debate will focus on whether and for how long to extend all or portions of the tax cuts enacted during the Bush Administration in 2001 and 2003. As you probably know, the death tax is fully repealed this year (2010) but will return at the beginning of 2011 with a 55% top rate and meaningless $1 million exemption.
Other Bush era tax provisions will return to pre-2001 levels as well, meaning that capital gains taxes will go from 15% to 20%, and certain dividend income will match income tax levels (up to 39%). That's not all... if an extenders package is considered there is a relatively good chance that bond initiatives on NUCA's legislative agenda will be included. These include provisions to lift the cap on private activity bonds for water and wastewater infrastructure projects and expansion of the successful Build America Bonds program.
We'll also ask for a delay in the implementation date of the 3% government withholding tax, from 2012 to 2014, which will allow us to push for full repeal of the withholding provision early in the next Congress. Word on the street is that a vote on the dreaded "card check" legislation is still possible.
The Government Relations and Political Action Committee will meet on Wednesday, November 17, 9:00 am - 1:00 pm at the Capitol Hill Club, 300 First Street, SE, Washington, D.C. Several guest speakers will discuss issues of interest before participants head to the Hill for visits that afternoon. Even if you are not a member of this committee, we encourage you to participate in this important and timely event. Click here to register! NUCA Attends Bipartisan Transportation Meeting
Before Congress headed home to campaign, NUCA attended a briefing and panel discussion on Capitol Hill by the Bipartisan Policy Center's National Transportation Policy Project (NTPP) titled "Transitioning to a Performance-Based Federal Transportation Policy." Rep. Jim Oberstar (D-Minn.), chairman of the House Committee on Transportation and Infrastructure, discussed the challenges that will be addressed in the next highway reauthorization bill, noting that the time to complete projects must be streamlined to lower costs and reduce project completion time.
In March, 25 leaders met at a five-day NTPP workshop to determine how the U.S. can effectively move federal transportation policy toward a more performance-driven network. The current federal transportation program is considered to have limited accountability for results and no broad national goals. Many transportation experts acknowledge that transition to a performance-based highway program holds the best promise for optimizing use of existing and future resources. Two core areas of agreement from the workshop were outlined at the briefing: 1) the need for federal performance measures and 2) incentivizing performance. Specifically, panelists at the briefing suggested metrics are needed for the nation to have well defined transportation goals, and steps should be taken to link funding to performance in the next highway reauthorization bill.
Rural America Solutions Group on "Jobs-Killing EPA Regulations"
NUCA recently attended a forum hosted by the Rural America Solutions Group in the Capitol Visitor Center on Environmental Protection Agency (EPA) regulations and other initiatives that are hindering job creation and economic expansion in America's rural communities. The forum, titled "The EPA's Assault on Rural America: How New Regulations and Proposed Legislation are Stifling Job Creation and Economic Growth," included a panel discussion on a range of EPA proposals and related legislation, including legislation that would expand federal jurisdiction under the Clean Water Act.
Additionally, EPA plans to issue total maximum daily load (TMDL) requirements for the Chesapeake Bay by the end of this year. This is intended to be a blueprint for similar plans in other watersheds throughout the country. "Proposed rules and bills that impose the federal government's reach on mud puddles, irrigation canals and driveways have left some wondering whether the EPA really stands for Eliminate Private Agriculture," said Rep. Doc Hastings (R-Wash.), co-chair of the Rural American Solutions Group. "It's time for EPA to ease its iron grip on rural America and start to listen to those who would be impacted." NUCA continues to monitor the group's activities and will work with likeminded organizations to address these issues.
Senate Banking Committee Talks Infrastructure and Job Creation
As reported last month, the president is pushing yet another economic recovery proposal by providing significant funding for America's surface transportation infrastructure. The plan includes $50 billion in funding for highways, railroads, transit and airports, and would create an infrastructure "bank." To further investigate the concept of a national infrastructure bank, the Senate Banking Committee recently held a hearing entitled "Investing in Infrastructure: Creating Jobs and Growing the Economy." Witnesses included representatives from the Department of Transportation and Department of Treasury, and Gov. Ed Rendell (D-Penn.), as well as transportation industry representatives. After noting the importance of the Interstate Highway System developed under the Eisenhower Administration, Committee Chairman Chris Dodd (D-Conn.) went further, noting that "Eisenhower's initiative was broad in scope, and bold in conception. It built upon over a century of investments in our railroads, ports, water and sewer systems, and other infrastructure. These investments helped build the world's strongest economy." Gov. Rendell discussed several funding options that should be considered, including two bond initiatives high on NUCA's legislative agenda. According to Rendell, Congress must "ensure that the Bank has the authority to employ a range of finance and funding tools including, but not limited to: grants, credit assistance, low interest loans, tax incentives, Build America Bonds, Private Activity Bonds... and others to be determined." NUCA continues to support the concept of a National Infrastructure Bank, and we believe it should be funded by any and all viable financing alternatives. This is sure to be a big issue next year, when the 112th Congress convenes and infrastructure investment will again be a hot topic. |
