It may be hard to believe but 2009 is just about over and a new year will be upon us in no time. As an Association, the end of the year brings a time to look back and review accomplishments and activities, but even more so, it's a time when we can look ahead and plan for the upcoming year.

 Lawsuit Update
 
 On April 27, 2009, NUCA of NM became a plaintiff in a lawsuit against the State of NM (and others) in regards to the passage of Senate Bill 33 that was signed by Governor Richardson after it passed through the 2009 Legislative Session.
 
This bill does away with the current Wage Survey that determines prevailing wages and replaces it with Collective Bargaining Agreements. NUCA of NM challenged the legislation during the session and signed on as a plaintiff in the lawsuit for a declaratory judgment to hold the statute unconstitutional and void.
 

At the Department of Workforce Solutions' meeting regarding the rules and regulations in order to comply with the law, Wayne Bingham stated, on behalf of the lawsuit's plaintiffs, that since we believe the law to be unconstitutional then subsequently, we also oppose the proposed rules and regulations. Jane Jernigan reiterated Bingham's statement for the record on behalf of NUCA of NM.

NMRCGA Tackles Some Issues
 
  
  The NMRCGA has voted to form three committees to study and make recommendations regarding certain industry issues. These committees will be looking for input from all stakeholders and welcome anyone who wishes to participate to do so. Information on the committees can be obtained by calling Gwen at 505 254 7315. The three committees are:
  • Mandatory White Lining - While white lining is not currently mandatory in the excavation law, it is, however, an expected practice and is part of the CGA's best practices. White lining is a very good tool for communication to the spotters exactly where the excavator intends to dig. Most sites would benefit from white lining, but many projects involving larger areas and work more complicated than the standard ten days may require additional consideration.
  • Spotting homeowner service lines - While the excavation law currently requires that facility owners only spot the facilities they own, many believe that service lines should be included. Several states have or are taking action to have facility owners spot service lines regardless of ownership. The issue of facility owners deriving revenue from the service lines has been one of the reasons for requiring these lines to be spotted. Currently, CGA has undertaken review of this issue and is considering making it a best practice.
  • All new installations of UG systems must be traceable - Many facility owners are still installing new systems without the ability to trace their location. Economics and aged specifications are to blame. However, the problem of locating underground facilities that are not traceable becomes a nightmare and a huge expense for future generations. What must be done to change the current practice and how will it be accomplished?

Community Service Project

NUCA of NM is teaming up with the City of Rio Rancho, Big Brothers/Big Sisters, and the Lowes Heroes foundation to help restore and re-build an abandoned park in Rio Rancho for ADA kids and other visitors. The project is set for completion in two phases and includes, dirt work, curb and gutter, asphalt, trails, planting etc.
