 Ballots for the 2010 Board of Directors are due by no later than Monday, November 2, 2009. If you have not returned your ballot, please do so by fax to ensure that I receive it in time. Fax 505 884 0668. If you did not receive a ballot, please contact me ASAP at the Association office - 505 888 0752. Remember there is only one vote per company.
 
November 11, 2009 is Veteran's Day. Please remember our veterans and show appreciation for their service. There are so many ways to help with veterans through non-profit groups and this year, the Ohh La La Christmas is raising money for the Wounded Warriors. See below for more information on how you can get involved in this worthwhile cause.
 
The Board of Directors will be holding it's annual Planning Session in December and they welcome your input. If you have an idea - big or small - for the Association, please forward to me through email or call me at the office. NUCA of NM exists for the benefit of its members, so your input is essential in maintaining and creating member benefits and services.  
 
Just a reminder! The Early Bird Registration cutoff date for the NUCA Utility Construction EXPO is October 30, 2009. You save $125 Every third member from your company receives a free registration.

 Lawsuit Update
 
 On April 27, 2009, NUCA of NM became a plaintiff in a lawsuit against the State of NM (and others) in regards to the passage of Senate Bill 33 that was signed by Governor Richardson after it passed through the 2009 Legislative Session.
 
This bill does away with the current Wage Survey that determines prevailing wages and replaces it with Collective Bargaining Agreements. NUCA of NM challenged the legislation during the session and signed on as a plaintiff in the lawsuit for a declaratory judgment to hold the statute unconstitutional and void.
 
The Plaintiffs entered into this lawsuit with the intent to win. There have been several actions in the past few months that I'd be happy to discuss with you over the phone in more detail, but for the basics:
  • Complaint (Lawsuit) was filed with the United States District Court of New Mexico.
  • The NM Building & Construction Trades Council filed a motion to intervene.
  • Motion to intervene was denied.
  • Defendant filed motion to dismiss.
  • Plaintiff filed motion to extend time to respond to defendant's motion to dismiss.  

The Department of Workforce Solutions has been working on the rules and regulations in order to comply with the law (if plaintiffs' complaint is dismissed or lost).

 Notice was printed in the ABQ Sunday Journal that a hearing will be held on Monday, November 23, 2009 to take oral or written comment on the proposed rule change in regards to SB 33 Prevailing Wage Rate on Public Works Projects.

NMRCGA Tackles Some Issues
 
  
 The New Mexico Regional Common Ground Alliance (NMRCGA) will be discussing some tough issues which may be concluded with an Industry Best Practice. The three issues being dealt with first are:
  • Marking lines including home owner's property
  • Pre-Marking in White
  • Wide Area Locates

If you are interested in contributing your thoughts and experience with these issues, please attend the next NMRCGA General Meeting on January 15, 2009. I will also keep you up-to-date in the newsletter. If you cannot attend the meeting, please contact me at 505 888 0752 and I will submit your comments at the meeting.  

NUCA "TOOLBOX TALKS" NOW AVAILABLE AS PODCASTS

NUCA's ever-popular "Toolbox Talks" saftey series is being made available (to NUCA members only) on a trial basis as podcasts.  Podcasts are digital media files that can be downloaded for audio players (mp3 file) or played on a personal computer.  This format of the "Toolbox Talks" is a simple way for supervisors and foreman to provide safety presentations.  They are designed to be played in the field at jobsites using a portable player or vehicle radio as part of a company's weekly toolbox talk.  
 
As a part of this trial, NUCA has converted three toolbox talks into podcasts: 3-Point Contact, Confined-Space Entry, and Trench Safety.  Based on feedback and number of hits to the podcasts, NUCA will determine whether these are useful membership tools and develop more podcasts.  Visit NUCA's web page at www.nuca.com

Community Service Project

 NUCA of NM is teaming up with the City of Rio Rancho, Big Brothers/Big Sisters, and the Lowes Heroes foundation to help restore and re-build an abandoned park in Rio Rancho for ADA kids and other visitors. The project is set for completion in two phases and includes, dirt work, curb and gutter, asphalt, trails, planting etc.

NUCA of NM Board of Directors is excited to be a part of this community project and it's easy for you to become involved. At this time, we're working on the parking area and asphalt trail and more volunteers will be needed in the spring for planting trees, shrubs, grasses, and installing pic-nic tables, basketball court and more.

Ooh La La Christmas 
 
Ohh La La Christmas is hosting two events to raise awareness and money for the Wounded Warrior Project. First, Warriors for the Wounded, A Salute to our Heroes on Friday, November 6, from 6pm to 9:30pm. The second event is the two-day Ooh La La Christmas Home Tour on Saturday, November 7 from 11:00am - 7:00pm and Sunday November 8 from 11:00am to 5:00pm.
