NUCA of NM Newsletter
July 29, 2009
From the Executive Director's Desk,

--Friday,  July 31, 2009 is the last day to report June 2009 activity on the  NM Department of Workforce Solutions Labor Relations Division Prevailing Wage Survey. Please submit your payroll data for Public and Non-Public Works construction projects for all work performed in the month of JUNE 2009. The data submitted will set new wage rates for all public works construction projects in 2010.

It is very important for our industry for you to participate in this survey,  since NUCA of NM is a plaintiff in a lawsuit which is striving  to  keep this survey intact for future reporting rather than using collective bargaining agreements. CLICK HERE to go directly to the NMDWS Web Page. There have been some problems with the online system, so please call to ensure that your data was received or send hardcopy via fax and/or mail. See specific instructions on the web page.

There is a new section of the newsletter titled, "What our Members are doing" where information will be posted on such things as member's anniversaries, open house, charity events, causes etc. If you would like to submit information to appear in the newsletter, please contact me at the office: 505 888 0752 or submit the information via email to nucanm@nucanm.org.

The Planning Committee has been working hard on the Annual Golf Tournament, Last Ditch Open, which is scheduled for September 18, 2009 at the Santa Ana Golf Course. This year, we're having a morning shot-gun start! Look for your registration information in the mail, or simply register online. There are plenty of sponsorship opportunities still available.

CICA -

APDThe Construction Industry Crime Alliance (CICA) was created to help the businesses in the construction industry. All NUCA of NM members are welcome to attend and sign up for crime alerts and information at the APD web page www.safecityabq.org.

We will meet monthly at NW Area Command Headquarters; 4051 Ellison Avenue, NW 87114 (right across the street from Cibola High School) The next meeting will be on August 11 , 2009  at 10:30am.

*** date changed so that Rocky can attend

The CICA is a tool for Association members that sends out alerts of job-site crime and also has the ability for you to report crime on your job sites (system is not intended to be used in place of an actual police report). This program is an avenue to work closely with APD to help curtail job-site crimes and catch the criminals in the process. Bring your concerns, reports, incidents (even un-reported) to this meeting where you can also sign up on-line to receive valuable information about crime on construction job sites.

To become a member you must sign up through the APD Web Page and then be verified as a NUCA of NM Member.

CLICK HERE to go to the web page to sign up. The CICA is second on the list.

E-Verify Mandatory on Federal Contracts Starting September 8

Everify LogoBeginning Sept. 8, the federal government will only award contracts to companies that use the online E-Verify system to determine their workers' immigration status; businesses receiving money under the federal stimulus program will also be subject to the rule. A decision regarding a separate but equally important issue is also worth noting. Department of Homeland Security (DHS) Secretary Janet Napolitano has rescinded the so-called "no-match" provision that would have required employers to fire workers whose name and Social Security numbers did not match information listed in the Social Security database. Such a policy could have opened the door to unwarranted penalties and litigation against employers in situations beyond their control.

Last December, the U.S. Chamber of Commerce led a group filing a lawsuit against the DHS in the District Court of Maryland over E-Verify on the grounds that it lacks the legal authority to make use of the program mandatory. That lawsuit, which NUCA is contributing to through resources from its Strategic Advocacy Fund, is still pending. A hearing on the matter is set for August 15. NUCA shares the group's concerns about E-Verify, including the inadequacies of the E-Verify program, the length and difficulty of the process, and the considerable number of "false positives" due to identity theft and errors.
