Changes to amend NM DOT Standard Specifications for highway and bridge construction - 18.27.2 NMAC Sections 7, 8 and the addition of new Section 9 have been formulated and proposed. John Taylor, NUCA of NM Vice-President is Chairing a Task Force that will review the language and ultimately offer opinion and recommendations at the Public Hearing and during the Public Comment period. (still to be determined at this time) The proposed language is in response to Governor Richardson's initiative to prevent the use of drug and alcohol in the workplace. If you would like a copy to review, or would like to serve on the Task Force, please contact the Association office at 505 888 0752.
The Construction Industry Crime Alliance (CICA) will meet at NW Area Command Headquarters; 4051 Ellison Avenue, NW 87114 (right across the street from Cibola High School) on June 3, 2009 at 10:30am. The CICA is a tool for Association members that sends out alerts of job-site crime and also has the ability for you to report crime on your job sites (system is not intended to be used in place of an actual police report). This program is an avenue to work closely with APD to help curtail job-site crimes and catch the criminals in the process. Bring your concerns, reports, incidents (even un-reported) to this meeting where you can also sign up on-line to receive valuable information about crime on construction job sites.

OSHA's Multi-Employer Policy Upheld |
|
OSHA's multi-employer citation policy is back in the news again. A recent court decision has reversed a previous decision and upheld an OSHA policy that allows a general contractor to be cited for violations committed by a subcontractor. The recent decision involved Summit Contractors, Inc.-a general contractor who was cited in 2003 under the multi-employer policy. Both Summit, which was considered a "controlling contractor," and the subcontractor were cited. Summit contested the violation and the Occupational Safety and Health Review Commission (OSHRC) vacated the citation in 2004. In 2007,OSHA petitioned for review with the Court of Appeals. In March of this year, the appellate court vacated the OSHRC decision. As a result, OSHA will continue to apply the multi-employer policy. According to Noah Connell, deputy director of OSHA's Directorate of Construction, the policy does not really hold the controlling contractor strictly liable for everything that may go wrong as a result of actions or inactions by a subcontractor. However, construction industry advocates believe the multi-employer policy places undue expectations on controlling contractors to ensure that subcontractors are in compliance with all, not just the obvious, potential hazards. It is not over yet, but it appears that OSHA's multi-employer policy will remain "business as usual" unless Congress or the Secretary of Labor changes the policy.
