State Chamber Updates
House Committee Approves Legislation Creating a Quick-Action Closing Fund for Economic Development
OKLAHOMA CITY-In recent years, Texas and Arkansas have landed a number of economic development deals at least in part because of their ability to enhance the financial incentive package on the table in the final stages of site selection.
Legislation passed this week by the House Economic Development, Tourism & Financial Services creates the Oklahoma Quick Action Closing Fund. The fund-which will share similarities with the Texas Enterprise Fund and the Arkansas Quick Action Closing Fund-will help Oklahoma compete with other states for much-needed jobs and investment.
House Bill 1953, by Rep. Skye McNiel, R-Bristow, makes substantial changes to the Oklahoma Opportunity Fund, which was first created in 2006. The changes include:
Ø changing the name to the Oklahoma Quick Action Closing fund
Ø addressing the project approval process by authorizing the governor to make the final decision on a project, subject to consultation with the Speaker of the House and President Pro Tempore of the Senate
Ø requiring a project to enter into an agreement with The Department of Commerce, who shall administer the Fund, and mandating that the agreement be performance based, providing a "net economic benefit" to the state
Ø a "claw back" provision for failure to meet performance provisions
"Oklahoma has a lot to offer companies looking to relocate, including a low cost of living, high quality of life, ample space and minimal traffic. But, the reality is we must compete with other states and the economic incentives they offer," said State Chamber President Fred Morgan. "This legislation puts in place tight 'net economic benefit' requirements, and includes a 'claw back' provision to protect the taxpayers' investment in a case a deal does not come through as promised. With these safeguards in place, this fund will be a critical tool for our state and our economic development efforts." |
