Special Pricing for National Estate Planning Awareness Week EXTENDED
In October, we celebrated National Estate Planning Awareness Week by offering special prices on a Financial Power of Attorney and Medical Power of Attorney package: $150 for a single person and $225 for a couple. NAELA Frigon Named Treasurer of the Special Needs Alliance

Special Needs Alliance (SNA) is a national non-profit association of attorneys committed to helping individuals with disabilities, their families and the professionals who represent them. SNA advocates on behalf of individuals with disabilities by furthering public policy initiatives as well as collaborating with organizations such as the Arc, the National Alliance on Mental Illness (NAMI) and the Autism Society of America (ASA). Mr. Frigon stresses the complexity of providing for a loved one with special needs. "Unfortunately good intentions are not enough; trust law, public benefits, and tax regulations must be incorporated in creating a solid special needs trust."


SNA membership is based on relevant legal experience in the disability and elder law fields, active participation with national, state and local disability advocacy organizations and professional reputation as an expert in special needs law.


Mr. Frigon, based in Denver, Colorado,  serves as the Treasurer of the National Academy of Elder Law Attorneys(NAELA), is a Certified Elder Law Attorney (CELA), is on the board of the Colorado Fund for People with Disabilities, and was appointed by the governor to serve on the Colorado Advisory Council for People with Disabilities.
 

The ARC Conference in Denver 
The Arc, a national organization for people with intellectual and developmental disabilities, held its 60th annual convention in Denver this Fall. Based in Washington, D.C., The Arc serves as a resource for individuals, including parents, educators and professionals, and provides information and support on diagnosis, policy issues, and legal issues and considerations. 

Brad attended the conference to represent the Special Needs Alliance and talked with a variety of attendees who stopped by the Special Needs Alliance booth to inquire about topics such as choosing trustees and how to find a special needs attorney near their hometowns. A heavily attended presentation by one of our SNA members addressed employment opportunities that do not endanger eligibility for government benefits. As a member and officer of the Special Needs Alliance, Brad is at the forefront of special needs law and able to assist with trust, public benefits and tax considerations to create a solid special needs trust.

2012 Medicare

Premiums and DeductiblesMarriage 

 

healthcareStarting January 1, 2012, the premium for Medicare Part B will decrease to $99.90 for single Medicare beneficiaries who have an annual income of $85,000.00 or less ($160,000.00 or less for a married couple). The premium decrease represents a $15.50 decrease over the 2011 premium of $115.40. However, most Medicare beneficiaries fell under a "hold harmless" provision in Medicare law in 2011 and paid only $96.40 per month. The 2012 premium represents a $3.50 increase for them.

  

Beneficiaries with an income of more than $85,000 (or $160,000.00 for a married couple) per year will pay higher premiums. When determining income, keep in mind that Social Security will look at your adjusted gross income for the last 2 years to determine your income for purposes of determining the Medicare Part B premium.
  
The Medicare Part A (hospital insurance) deductible will increase to $1,156 per admission. The co-insurance for days past the initial 60 will also increase.

  

The reimbursement paid to insurance companies for Medicare Advantage plans is decreasing by 4%.
It's Earlier this Year!
Annual Open Enrollment is from October 15 to December 7

Every year, people with Medicare can explore new choices and pick the health and drug plans that work best for them during Medicare's Open Enrollment period. This year, the Open Enrollment period started earlier, on October 15, and ends sooner, December 7. This gives people with Medicare a full seven weeks to compare and make decisions, and ensures that they will have essential plan materials and membership cards in hand on January 1, 2012 when new coverage starts.


According to Medicare, there will be a wide range of health and drug plan options available across the country, including Original Medicare. Most people with Medicare can choose a "Part D" plan to help them pay for prescription drugs. And people who have chosen to enroll in a "Part C" Medicare Advantage plan for their basic health care services have the option of staying in that plan, choosing a different plan, or going back to the Original Medicare program. Plans can change from year to year, so these are important choices that should be made with care. People can turn to www.medicare.gov, call 1-800-MEDICARE, or consult with a local State Health Insurance Assistance Program (SHIP) for help.
