"Recently my landlord has been demanding to show my apartment to prospective tenants. He doesn't ask if I'm available, and doesn't give me notice before he enters the apartment. Can I refuse to show the apartment? What should I do and what are my rights as a tenant in this situation?"

Dear Frustrated
Per state law, the landlord or realtor must provide  "reasonable" written or electronic notification before showing the apartment. You don't have to be at home, however you can request this courtesy. If the problem continues, contact Boston's Rental Housing Resource Center for help at (617)-635-7368.

Look Before You Leap 
Got Heat?
 Are you aware of your rights as a tenant when it comes to heating your apartment?  In the City of Boston, the Department of Health has set guidelines for landlords. The landlord/management company is responsible for maintaing heat in every habitable room and every room containing a toilet, shower, or bathtub at 68°F (20° C) between 7:00 A.M. and 11:00 P.M.  HeatBetween the hours of 11:01 P.M. and 6:59 A.M., the temperature must be at least 64°F (17° C).  These temperatures are required every day between September 15 to June 15, except in cases when the tenant is required to provide the fuel as stated in your lease.

 

The temperature should not go over 78°F (25° C) during the heating season. The temperature may be read and the requirement met at a height of five feet above floor level on a wall any point more than five feet from the exterior wall.

 

To ensure that your landlord abides by all rules, contact Inspectional Services Department to schedule a time for your apartment to be inspected. Call (617) 635-5322 or click HERE.Once you apply for an inspection, it is the obligation of your landlord to pay the fee to get your apartment inspected.

There is an ordinance in Boston requiring no more than four full-time undergraduate students may live in the same apartment regardless of its size. If you sign a lease for an apartment with more than four students, you could end up in a bad situation. When the Boston Inspectional Services Department (ISD) finds out that there are more than four undergrads living in the same unit (even if your landlord permitted this) the landlord will be forced to kick people out until the number of occupants is reduced to four people. Don't be caught short - THINK BEFORE YOU SIGN!
