The Federal Trade Commission is Enforcing a New Law
The Red Flags Rule

●    In 2008 Congress enacted the Red Flags Rule. Enforcement begins June 1, 2010. (BREAKING NEWS: For Release: 05/28/2010: At the request of several Members of Congress, the Federal Trade Commission is further delaying enforcement of the "Red Flags" Rule through December 31, 2010 Follow links on our web site for the latest http://www.ecshredding.com/news/redflaglaw.html
●    Purpose is to reduce identity theft and consumer fraud.
 
●    The Red Flags Rule applies to "financial institutions" and "creditors".
 
●    "Financial Institutions" are state and national banks, state of federal savings and loan associations, state or federal credit unions, mutual savings banks or any person who holds a consumer transaction account.
 
●    "Creditors" are businesses and organizations that regularly defer payment for goods and services or provide goods and services and bill customers later or that grant loans, arrange for loans or extension of credit or make credit decisions.
 
●    Examples are finance companies, mortgage brokers, real estate agents, automobile dealers and retailers that offer financing or help consumers get financing from others.
 
●    Must determine if you have any covered accounts.
 
●    First, are consumer accounts that are designed for multiple payments or transactions
 
●    Second, are accounts for which there is a reasonably foreseeable risk to customers
or to the safety and soundness of the financial institution or creditor from identity theft.
 
●    Complying requires many businesses and organizations to implement a written Identity Theft Prevention Program.
 
●    Must identify the relevant "red flags" of identity theft in your day-to-day operations.
 
●    Must be designed to detect the "red flags" you've identified.
 
●    Must spell out appropriate actions you'll take when you detect "red flags".
 
●    Must address how you will re-evaluate your program to react to new risks.
