Long Service Corporation
The Long Service Corporation administers a scheme which provides a portable long service benefit for eligible workers and self-employed workers in the building and construction industry in NSW.
All benefits and requirements are determined by the Building and Construction Industry Long Service Payments Act 1986.
The scheme allows eligible workers in the industry to work for different employers or as subcontractors and qualify for a long service benefit that is paid for by a levy on building and construction work in NSW. The levy is collected by the Corporation and its agents and is invested in accordance with NSW Treasury requirements until required to fund long service payments.
Employers are required to advise the Corporation who worked for them during each financial year. Service is allocated to workers based on this information. Self employed workers can also record service and become entitled to a benefit. There is no cost to employers or workers to belong to the scheme however, employers do have legal obligations to meet.
The building and construction industry is the carrying out of construction, reconstruction, renovation, alteration, demolition or maintenance or repairs of or to buildings, etc.
- Employers do not pay direct contributions for their employees in NSW.
- There are no other fees or charges for employers or workers in respect of the scheme administered by the Corporation in NSW.
- The scheme is funded by a levy on building and construction work of $25,000 and above in NSW, and paid by the person for whom the building and construction work is being performed.
The Scheme pays the equivalent of 8.67 weeks pay for 10 years of recorded service. The amount of payment is based on award rates of pay or the rate of pay under a registered enterprise bargaining agreement. Benefits may be payable for workers with less than 10 years of recorded service in certain cases and are calculated on a pro rata basis.
