Action To Implement RUGs IV
Nursing homes around the country are awaiting the final act of the Government to determine whether the RUGs IV reimbursement system will be implemented October 1, 2010 or delayed a year until October 1, 2011. A Bill which is currently going through the process of becoming Law will be the final determining factor in this back and forth battle. The Veterans', Seniors' and Children's Health Technical Corrections Act of 2010 (H.R. 5712), if passed will repeal the Skilled Nursing Facility (SNF) Payment Delay. This provision repeals a one-year delay of the implementation of the Resource Utilization Group Version Four (RUG-IV). The Bill was created to provide for certain clarifications and extensions under Medicare as well as Medicaid and the Children's Health Insurance Program. On July 14, our industry got word that the House passed this bill that would eliminate the one-year delay to the RUG-IV case-mix classification system. There are more steps involved in getting this Bill passed to Law, but we are well on the way to implementation of RUGs IV as of October 1, 2010. What do we know about H.R. 5712?

It was a very busy week for long term care as we were also gifted with the CMS update to the Payment Rates used under the prospective payment system for skilled nursing facilities for fiscal year 2011. The rates will take effect October 1, 2010. The Rule will post in the Federal Register on July 22, 2010. CMS will then allow for a 60 day public comment period on the Rule once posted in the Federal Register. CMS announced nursing home payment rates for fiscal year 2011 will increase 1.7 percent. This increase will result in an estimated $542 million increase in Medicare payments to nursing homes across the country during FY 2011.
