Rehab Aides in the SNF setting; A Change in the Ruling? There has been much industry buzz regarding the use of Rehab Aides and whether CMS published changes to the definition of Rehab Aide utilization during a skilled Medicare Part A stay in the SNF. The SNF final rule released in 1999 and the RAI User's Manual for the Minimum Data Set Version 2.0, state that the minutes of skilled therapy services provided by aides under line-of sight supervision of the therapist are billable as therapy minutes on that date of service. PT assistants and COTAs are not allowed to supervise aides in the SNF setting for billable minutes to be coded on the MDS. Currently there have been no changes to the rules governing use of Rehab Aides in the SNF for beneficiaries being covered under Medicare Part A services. CMS has issued manual guidance on the use of aides in the SNF Part A setting, and that guidance can be found in the RAI User's Manual. Chapter 3, page 3-189 of the RAI Users manual states: Supervision (Medicare A only): "Aides cannot independently provide a skilled service. The services of aides performing therapy treatments may only be coded when the services are performed under line of sight supervision by a licensed therapist when allowed by state law. This type of coordination between the licensed therapist and therapy aide under the direct, personal (e.g., line of sight) supervision of the therapist is considered individual therapy for counting minutes. When the therapist starts the session and delegates the performance of the therapy treatment to a therapy aide, while maintaining direct line of sight supervision, the total number of minutes of the therapy session may be coded as therapy minutes." CMS may further clarify guidance for use of Therapy Aides, based on a brief statement in the Final Rule, released November 27, 2007 and found in the Federal Register (Code of Federal Regulations), CMS, on pg. 178, which states: "(c) Except as specified in paragraph (c)(1)(ii) of this section, physical therapy, occupational therapy or speech-language pathology services must be furnished- (1) By qualified physical therapists, physical therapist assistants, occupational therapists, occupational therapy assistants or speech-language pathologists as defined in part 484 of this chapter." Harmony will continue to update this information as it becomes available.
