Tax Bill Extends many Bush-era Tax Cuts; Offers 100% Depreciation for Businesses; New Estate Tax Rules        

The Tax Relief, Unemployment Insurance Reauthorization and Job Creation Act (2010 Tax Relief Act) was signed into law by President Obama on December 17th providing a two year extension on many Bush-era tax cuts as well as several new tax relief measures. 

 

Following are some of the extensions through Dec. 31, 2012:

*       Maximum capital gain and dividend tax rate of 15% for individual taxpayers

*       Lower individual income tax rates

*       Marriage penalty relief

*       AMT patch

*       Enhanced Earned Income Tax Credit

*       $1,000 Child Tax Credit

*       "Pease" limitations

*       Repeal of Personal Exemption Phase Out (PEP)

*       Adoption Credit and Dependent Care Credit

*       American Opportunity Tax Credit (formerly Hope Education Credit)

*       Education Assistance Exclusion (of up to $5,250 in employer-provided education assistance)

*       Deduction of certain mortgage insurance premiums

*       Elimination of 60-month rule for $2,500 above-the-line student loan interest deduction; Armed Forces Scholarship Program and National Health Service Corps Program exclusion; and Coverdell Education Savings Accounts maximum contributions of $2,000

*       Individual Tax Extenders including state and local sales tax deduction, higher education tuition deductions, charitable contributions of IRS proceeds and teacher's classroom expense deduction.

 

New tax relief measures include the following:

*       Reduction in Social Security payroll deduction by 2% for the calendar year 2011

*       Return of estate tax but with a reduced maximum tax rate of 35% and a $5M exclusion (click below for more info)

*       Business incentives such as 100% bonus depreciation and changes in section 179 expensing (click below for more info)

Reverse Exchanges Make Comeback  
Preserve Ability to Defer Gain without Buyer 

After a few years' hiatus, reverse exchanges are making a comeback!  This is an encouraging sign that the real estate market is improving.  Until recently, we have seen the reverse exchange activity come almost to a stand still.  Many investors wanted to acquire their desired replacement property but their real estate professionals were not optimistic about finding a buyer for their relinquished property within the next 180 days.  However, a renewed interest in reverse exchanges point to renewed hope and investors are again electing to structure reverse exchanges to help preserve their ability to defer their gain through a 1031 tax-deferred exchange.    

 

What Is A Reverse Exchange?

A reverse exchange is a strategy used when you want to defer the capital gain under section 1031 but must acquire the replacement property prior to conveying title of your relinquished property to a buyer.  The most common situations that necessitate a reverse exchange include:

*       You must settle on the replacement property or lose substantial down monies. 

*       Contingencies on the sale of the relinquished property have not been removed prior to the closing of the replacement property. 

*       A buyer for the relinquished property has not been found and the closing on the replacement property cannot be postponed without jeopardizing the transaction.

*       Favorable financing commitments will expire without the immediate acquisition of the replacement property.

*       You wish to make improvements to the replacement property which cannot be completed within the 180-Day Exchange Period.
