October 2009 Newsletter

Greetings!

Autumn - a time when nature starts the renewal process by shutting down those parts which will not contribute during the expected harsher climate, and concentrates on the survival of the core. Until springtime, when renewed growth and vigour take hold, always making sure you are fit for the most appropriate need.

Analogous to today's economic climate? In many ways it is - you ought to be making sure your business gets its core products or services right, whilst preparing grow when the conditions are more favourable.

Too early for a spring-clean, perhaps...but maybe the right time to look again at what really adds value for you. When was the last time you reviewed your strategy, for example...
Dateline: October 1 2009...

1st of month
Called the 'Common Commencement dates' April and October 1st. are the times when a myriad changes to the various frameworks affecting business are introduced. The original idea was to reduce the number of alterations a business has to manage during the year. The risk, of course, is that something may be missed amongst the welter of new and updated regulations due.

Changes this time include: several company deregulation additions, making administration simpler; new national minimum wage figures, and the exclusion of tips; and, crucially for companies thinking about downsizing, higher redundancy payments.

Business Link has a summary here - don't get caught!
Business Angels

Helping HandsOakview Consulting has access to the UK's largest Business Angel fund specialising in distressed companies in need of urgent turnaround funding, or help in negotiating with creditors such as VAT and PAYE.

This may be more relevant in today's financial climate.

The fund is actively looking for good companies that have hit hard times for genuine reasons that can be explained. Even the most serious cases will be considered. These types of companies can often be helped with an injection of additional capital and new ideas.

If your business is experiencing difficult times, but has a success history to tell and a track record to match, please contact Oakview Consulting, to discuss your story and options. Before it's too late...
Legal Corner

Paperwork 090925 The Companies Act 2006 codified directors' duties for the first time in a long time. After a two-year phased implementation timetable, it's worth reviewing how it affects companies and their directors.

(1) To act within the company's constitution and to only exercise powers for a proper purpose - make sure that all decisions are within company rules;
(2) To exercise independent judgment - for the benefit of the company as a whole, and not a smaller number of shareholders.;
(3) To exercise reasonable care, skill and diligence - all directors must be competent, and where higher skills are anticipated, e.g.an FD, higher standards will be expected;
(4) Not to accept benefits from third parties - be sure that any gifts or hospitality do not create conflicts of interest;
(5) To declare interests in proposed transactions or arrangements with the company - better to avoid any appearance where personal links are involved;
(6) To act in good faith to promote... ...the success of the company - running thecompany for the benefit of its members as a whole, including employees, the wider community and the environment;
(7) To avoid conflicts of interest - making sure all know, and record all decisions approving these conflicts.

So - they've been a long time coming, but have been in a while. How confident are you that your company is operating legally? Time to think...and maybe get advice...
Is software the answer...

Business Continuity software abounds - and like most software is more powerful than many users appreciate.

But is it good enough for your business needs? Or, does it give you a false sense of security?

The better software packages provide a basis from which to write a plan, and can be used to build an ability to cope with disruption. The real trick is ensuring you and your staff have the capability to cope with most things that come your way.

In other words, without the proper approach, testing and training, software will give you the words alone. Not the knowledge to take decisive action.

So, if you go the software route, be sure it's right for you, and be sure you have the approach and support necessary to make that planning process robust enough to protect your most important assets.

Your people; and, your business.
...in closing...

This Autumn - don't leaf (sic) your business to fall (groan).

Get your finances sorted; stay legal; and be sure your plans are actionable. Look after your livelihood.
