Musicians as employees or independent contractors?
| Denver Original Music May 26, 2012 Are you a full time musician in Colorado (or part timer generating income)? Band leader and/or sideman/woman? Then there is something you should know... Several cases have been coming before the Colorado Department of Labor recently; these involve the distinction between "employee" status and "independent contractor" status. And the DOL has been identifying IC's as Employees more eagerly, with pretty stout penalties. Colorado Revised Statute 8-70-115 includes nine articles for determining if a band member is an employee or an independent contractor. All nine points must be clarified to the satisfaction of the DOL, or a member will be ruled as an employee and the band leader is on the hook for substantial fines, even retroactive penalties. Lancaster Symphony union issue on way to appeals court

Jun 06, 2012 18:17 By TIM MEKEEL Staff Writer "An appeals court will decide once and for all the central question in the dispute - are the musicians employees or independent contractors? Under federal law, only employees are eligible to unionize."
The Lancaster Symphony Orchestra and the union trying to organize its musicians have moved a step closer to a final showdown in court. Local 294 of the American Federation of Musicians on Monday filed an unfair labor practice charge against the orchestra. The union alleges that the orchestra has refused to negotiate a contract that would cover its 127 musicians. A contract would be the first for the orchestra's musicians, who voted 50-34 earlier this year in favor of unionizing.

The Delaware Symphony Orchestra, a Wilmington cultural jewel for more than 100 years, is suspending its 2012-13 season while it seeks new sources of funding in a bruising economic environment.
Lee Williamson, the orchestra's executive director, said the move will allow the orchestra to "step back" while it spends the summer analyzing its operations before restructuring its business plan. The symphony's annual budget is $2 million. "It's not just about getting the money," she said Monday. "It's about being able to get the money and use it in the most fiscally responsible manner. ... We're doing our best to put together a plan so we can move forward." Read On

Music of Bruce Adolphe
As part of the collaborative series at Curious Theatre in 2011-2012, the Colorado Chamber Players presents The Tiger's Ear: Listening to Abstract Expressionist Painting - Bruce Adolphe's masterpiece for Flute, Oboe, Piano, Violin, Viola and Cello. The stunning sound portrait pays homage to Abstract Expressionist painters Clyfford Still, Jackson Pollack, Willem deKooning, Mark Rothko, Phillip Guston and Barnett Newman.
The Tiger's Ear will be performed just prior to Curious Theatre's play about Mark Rothko's life and work, Red. The music will be partnered with writings from The Tiger's Eye (the journal of art and poetry from the 1940s which inspired Adolphe), and Letters and writings about the painter. The Colorado Chamber Players will present this piece immediately preceding RED.
Performers will include Andrew Cooperstock, Piano; Paul Nagem, Flute; Lisa Martin, Oboe; Paul Primus, Violin; Barbara Hamilton, Viola; and Judith McIntyre, Cello - with readings by actor Mare Trevathan.
CCP members Paul Primus and Barbara Hamilton will be performing at the Lamont Pre-College Academy, Hamilton Hall, Lamont School of Music, Iliff and University Streets, in two free faculty concerts during the Academy.

Metropolitan Jazz Orchestra Presents Every month, MJO features two different high school jazz ensembles in concert at Dazzle! Playing the second and third Monday of each month (with some exceptions), the school plays one set followed by a set from MJO. The big finale includes both bands on stage featuring soloists from both groups. | June 6, 2012 Parlando School for the Arts announces the following faculty position: Violin Qualifications: Minimum Bachelors in Music is required. The ideal candidate is creative, flexible, innovative, and dedicated to teaching all levels and ages. Preference is given to teachers with experience and ability to teach multiple genres including solo fiddle or fiddle/improve classes; or ages/levels. Position: Instructors are part-time, hourly. The candidate needs to be available on weekdays from 3:30 into the evening. Responsibilities: Teach private and group lessons as needed. Other courses (such as summer camps, classes and ensembles) are possible depending on expertise. Teachers need to maintain a high level of professional activity including performance on faculty recitals and outreach concerts. Faculty members are expected to provide creative support for developing programs and curriculum in area of expertise. This place was built for musicians by musicians. We have 19,000 square feet spread out on two floors.
Our main room on first floor has tavern, restaurant, cabaret, billiards and a stage 4' 3" tall 16' X 24' with a 4'x8' cat walk. perfect for live performances, video production and live rehearsals.

Become a Certified Music Practitioner

Have you ever wondered if there is meaning "beyond the notes?" Are you interested in helping people through a difficult time in their life? If you have answered yes, then you might want to consider becoming a "Certified Music Practitioner (CMP)". A CMP plays therapeutic music by the bedside for patients in healthcare settings. CMPs are trained by the Music For Healing and Transition Program (MHTP), which is a national organization that has been training amateur and professional musicians to play therapeutic music by the bedside for patients for over 15 years. Summer Course in the Alexander Technique at CU Boulder, 7/14

The 18th Annual Summer Course in the Alexander Technique at the University of Colorado at Boulder will be held July 9-13, 9:00 to noon daily. A one day Intensive will be held July 14, 1-5:00 pm. The 2012 faculty includes Ed Bilanchone, Amy Likar, and DMA member James Brody. Early registration by DMA members will result in a 15% reduction in tuition.
The Alexander Technique is a powerful tool for changing habits in movement and thinking. While anyone can benefit from this Technique, the work applies especially well to musicians and educators. Participants will learn about generalized and specific body use issues that can affect both performance and educational settings, as well as practical skills for the classroom. The results of a medical study in England that investigated the Alexander Technique were recently published in the British Medical Journal. Latest Health Tip: Buy US Products

I recently went for a routine medical appointment at the VA Medical Center in Denver. Over the last several visits, my blood pressure was climbing just slightly. They gave me a blood pressure cuff to take home with me so that I could check it frequently and report the results back to them.
They told me that I'm entitled to one, because I'm an American Veteran. (Vietnam, etc.)
It was paid for with American Tax Dollars, through the Department of Veterans' Affairs, so I'm entitled to have one as an American Veteran. I really do appreciate having the cuff to take home with me so that I can keep tabs on my blood pressure.
Problem is that the blood pressure cuff raises my blood pressure.
How does it raise my blood pressure?
It raises my blood pressure because it is not made in the United States.
Nothing against other Countries, but we have unemployed Americans who could - and would be proud to - manufacture this item.
And especially regarding things that are purchased by our Veterans' Administration: We have unemployed VETERANS who could - and would be proud to - manufacture the item!

Secretary Solis was honored June 6 for her lifetime of advocacy on behalf of immigrant workers as she received the St. Joseph's Award at the Faith & Politics Institute's 15th annual breakfast. The award is named after the patron saint of workers. AFL-CIO President Richard Trumka presented her with the award, and Solis acknowledged the labor movement's work to fight for better wages and safer working conditions for New York City's taxi cab workers, many of whom are immigrants. "I'm proud to report that the Occupational Safety and Health Administration is doing its part as well by advocating for security cameras, car alarms, GPS and bullet-proof partitions, which have reduced attacks on taxi workers nationwide by 88 percent," she said. Solis talked about her parents' immigrant heritage and society's responsibility to protect the most vulnerable workers. Quoting "Leviticus," she said: "When a stranger sojourns with you in your land, you shall not do him wrong."

Comprised of some Metropolitan State College students and community members, the band under the direction of Gerald Endsley meets on Tuesday evenings from 7-9 P.M. in the King Center Concert Hall on the Auraria campus. All wind and percussion instruements are welcome and there are no fees, auditions, or chair placements. The band generaly shares two concerts per semester with other metro ensembles. Community Band Seeking New Members (Edgewater/Lakewood)

Our non-profit Mile High Community Band seeks musicians of all ages, teen through adult, and at all levels of accomplishment, to join us for rehearsals on Thursday nights in Edgewater (just west of Denver).
Our organization's mission is to provide rewarding music education and performance opportunities for youth and adults at all skill levels. We have various bands for different skill levels, beginning through advanced, including jazz/blues and concert bands. In particular, we welcome additional brass and woodwind musicians.
We meet Thursday evenings at North High School (2960 Speer Blvd Denver) for rehearsals. Monthly memberships begin at $25-$35/month, but we can waive fees and provide instruments for those who need them - no one with an interest in playing music will be turned away. Family discounts also available.

Metal tubes extending into the bore in the finger holes of the wing and boot joints to prevent water from entering the tone holes.
