Contract extension keeps Philadelphia Orchestra playing, for now

Players and management of the Philadelphia Orchestra have opted for labor peace - at least for a few weeks.

 

Rather than seeking to abrogate the current contract and impose a new one in bankruptcy court, the Philadelphia Orchestra Association offered musicians an extension on a concessionary contract through Nov. 13.

 

Players, in residence at the Bravo! Vail Valley Music Festival, voted Friday to accept the extension, which keeps the base minimum compensation at $2,400 a week, or $124,800 annually (though most players make more, and some much more).

 

This gives both sides more time to reach a long-term deal while the association's Chapter 11 case continues. It also means this summer's planned residencies in Montreal and Saratoga Springs, N.Y., and three-week European tour in August and September can proceed without fear of a work stoppage.

 

"One hopes this gives both sides the time to find a solution," said cellist John Koen, chairman of the members committee. Read On 

Proposed $20 Million Cut to Arts Funding   

Once again, funding for the National Endowment for the Arts (NEA) is in jeopardy. Yesterday, the House appropriations subcommittee with jurisdiction over the NEA voted to cut NEA funding to $135 million for FY 2012. This is $20 million below current funding levels, and comes in addition to the $22.5 million cut sustained earlier this year during FY 2011 budget negotiations.

Given the need for fiscal restraint in order to resolve the national debt crisis, the arts community is prepared to make the same sacrifices as all other federal agencies. However, budget cuts should not be disproportionately directed at the arts. The proposed funding for the NEA is 13 percent below the current funding level, while overall funding in the bill, which includes agencies like the EPA, Interior Department and the U.S. Forest Service, is reduced by only 7 percent.

The full House Appropriations Committee will consider this bill on Tuesday, and it may be brought to a vote in the full House of Representatives before Congress leaves for the August recess. NLRB Affirms AFM Jurisdiction to Bargain Over Symphonic Media  

(New York, NY) A three-judge panel of the National Labor Relations Board (NLRB) has affirmed that the Musical Arts Association (MAA), which runs The Cleveland Orchestra, violated federal labor law by refusing to bargain with the American Federation of Musicians (AFM) regarding terms and conditions of employment related to electronic media productions. The NLRB rejected MAA's argument that it had complied with the law by making media proposals to AFM Local 4 (the Federation's affiliated local in Cleveland). The NLRB affirmed Administrative Law Judge Eric M. Fine's earlier finding that having signed media agreements with the Federation for many years, MAA was not free to shift media negotiations to a local basis.

"This is a resounding victory for the AFM, The Cleveland Orchestra musicians, orchestras throughout the US, and the union movement as a whole," says Ray Hair, AFM President. "The NLRB Panel has agreed that orchestra employers are not free to turn their backs on their long-term bargaining relationships with the Federation on electronic media issues. The Federation has reached media agreements with dozens of orchestra employers, and this is allowing orchestras to create cutting-edge ways of packaging and promoting their music, a win-win for musicians and management."

Despite warnings to orchestra managements signatory to AFM media agreements that they have a duty under the NLRA to negotiate with the AFM and not its Locals, in 2009 MAA (at the conclusion of group negotiations involving more than 70 symphony, opera, and ballet orchestra managements) began negotiating with Local 4 on electronic media topics. Alerted to this tactic by Local 4, the AFM filed charges, resulting in a complaint issued by the NLRB Region 8 Regional Director and a case that went to trial in September 2010.

In January 2011, Fine held that MAA committed an unfair labor practice when it refused to negotiate with the AFM. Fine also confirmed-contrary to MAA's position-that The Cleveland Orchestra musicians can recognize two collective bargaining representatives, one for local matters such as rehearsal conditions and one for electronic media topics.

"This case affirms the AFM's position as to the precise division of bargaining jurisdiction between the Federation and its Locals," says Deborah Newmark, Director, AFM Symphonic Electronic Media. "Judge Fine's decision made clear that the Federation's jurisdiction over media is supported by industry practice and the union's bylaws, as well as by MAA's prior course of bargaining and the terms of all the relevant contracts."

The Denver Municipal Band is the oldest professional concert band in the continental United States.

 

The Denver Municipal Band was founded in the late 1860s by Alex Sutherland, bugler at the "Charge of The Light Brigade." Surviving the ordeal, he settled in Denver where he was active in many of the city's early musical activities. Originally constituted as the GAR Post Band, it performed early municipally funded concerts throughout the 1870s and 80s, changing its name to the Denver Municipal Band in 1891 when it began its continuous history of Denver Municipal Funding.

Pianist Sergio Gallo Performs All Liszt Program
for Rocky Ridge Music Center Benefit House Concert

Estes Park, Colorado (July 12, 2011): Rocky Ridge Music Center cordially invites the public to a House Concert on Saturday, July 16th at 6:30 p.m. featuring pianist Sergio Gallo.  Mr. Gallo will present an all Liszt solo piano program, including, Vallée d'Obermann, Isolde's Liebestod, and Après une lecture de Dante. 

The event will be held at the beautiful Estes Park home of Madison and Marty Casey, longtime friends of RRMC. Tickets are $65 per person which includes dinner, wine, champagne, dessert and music.  Chefs Kevin Linville and Marty Casey have created a special menu for the evening--smoked salmon with dill sauce, pork shoulder with Italian salsa verde and sweet roasted pepper glaze, provolone and fresh tomato strata, baked brie, and grilled fresh asparagus and onions.  Dessert will be sponge cake with cherries jubilee and whipped cream.

Deja BluDeja Blu is an established regional variety dance band that plays weddings, corporate events, summer festivals and private parties. We've been together for over 10 years and we are currently 5 members including a lead female singer. We work with a full time sound man and offer optional 6- piece with a sax player. We have a business manager who handles all of the business side of booking, contracts, marketing, promotion and the web site. We all have flexible day jobs that allow us to take mid-week gigs in the summer and a few out of state weddings. We do about 50 shows/year with excellent money.

We are looking for an experienced player who can cover about 30% of the lead vocals. Must have an ear for harmony since 3 part harmony is vital to this band. Looking for strong, dynamic voice with power, range and great stage presence. We are asking for a 100% commitment to the band so, please - No guns for hire or anyone who works with multiple bands.

Summer Course in the Alexander Technique at CU Boulder, 7/11-15 

The 17th Annual Summer Course in the Alexander Technique at the University of Colorado at Boulder will be held July 11-15, 2011, 9:00 to noon daily. A one day Intensive will be held July 15, 1-5:00 pm. The 2011 faculty includes Ed Bilanchone, Tully Hall, and James Brody. Early registration by DMA members will result in a 10% reduction in tuition.

The Alexander Technique is a powerful tool for changing habits in movement and thinking. While anyone can benefit from this Technique, the work applies especially well to musicians and educators. Participants will learn about generalized and specific body use issues that can affect both performance and educational settings, as well as practical skills for the classroom. The results of a
medical study in England that investigated the Alexander Technique were recently published in the British Medical Journal. A link to a summary of the study and a short film about it can be found at:

DMA 2011-12 Wage Scales & Mileage Rates
For over 100 years, DMA wage scales have established minimum acceptable compensation for defined services. These rates are established by the membership. Additionally, all scales are adjusted annually by the Colorado Cost of Living Index, effective September 1st (for contracts filed after September 1) of the current year. Any disputes that arise over the terms of this Schedule of Wages shall be adjudicated by the Denver Musicians Association Board of Directors. Whenever feasible, the Board of Directors may negotiate an agreement with prospective employers for contributions to the AFM-EP pension fund on behalf of the employed musicians.

The IRS has also announced that mileage deduction will increase to .55 per mile. This rate, effective July 1, is now reflected in our scales for drivers, along with a .33 per mile rate for passengers.

The Next SCFD Board Meeting is set for July 28 at 1pm - Let's all go!! 

The June 23, 2011 SCFD board meeting was hosted by Hudson Gardens. The fiscal year 2010 audit was presented by Mark Elmshauser of Clifton Gunderson. The board passed Resolution 11-05 Pertaining to Acceptance of the 2010 Audit. 

 

Treasurer Bob Grant reported that the April 2011 SCFD sales and use tax revenue was $3,402,878.50. This compares to April 2010 revenue of $3,201,694.48. The variance is $201,184.02, a 6.28% increase over month-to-date (MTD) April 2010. The 2011 year-to-date (YTD) sales and use tax revenue is $13,119,242.08. This compares to YTD 2010 revenue of $12,062,462.94. The variance is $1,056,779.14, an 8.76% increase in YTD 2011 over YTD 2010. He also presented several five-year budget projections for board review and discussion.

 

Executive Director Peg Long distributed the 2011 Tier II Qualifying Organizations Report to board members. Twenty-five organizations applied and successfully qualified for 2011 Tier II SCFD funding. The 2011 qualifying revenue threshold is $1,392,789.98. The 2011 projected allocation for Tier II is $8,348,367. Tier II organizations will present their annual certification reports to the board at the July and August board meetings.  

 

In adopting Resolution 11-06 Pertaining to Recognition of the Scientific and Cultural Collaborative, the board acknowledged the important work of the collaborative over the past 17 years. The group is presently comprised of all Tier II organizations and The Denver Center for the Performing Arts.  

 

Councilwoman Marcia Johnson, the City and County of Denver appointee to the SCFD board, was honored for her six years of board service as well as her 22 years as an elected public servant. Appointees to the SCFD board may serve a maximum of two, three-year terms.  The Denver City Council has appointed Councilwoman Peggy Lehmann to be Ms. Johnson's successor on the SCFD board effective with the July 2011 board meeting.

 

The next regular SCFD Board meeting will be Thursday, July 28, 2011 at The Denver Center for the Performing Arts, Helen Bonfils Theatre Complex, Speer Blvd. and Arapahoe St..  The public meeting will begin at 1pm.

Community Band Seeking New Members (Edgewater/Lakewood)

Our non-profit Mile High Community Band seeks musicians of all ages, teen through adult, and at all levels of accomplishment, to join us for rehearsals on Thursday nights in Edgewater (just west of Denver).

Our organization's mission is to provide rewarding music education and performance opportunities for youth and adults at all skill levels. We have various bands for different skill levels, beginning through advanced, including jazz/blues and concert bands. In particular, we welcome additional brass and woodwind musicians.

We meet Thursday evenings at Jefferson High School in Edgewater for rehearsals. Monthly memberships begin at $25-$35/month, but we can waive fees and provide instruments for those who need them - no one with an interest in playing music will be turned away. Family discounts also available.

Rollers on F, Ab, Eb, Db, right thumb Bb and F#, in combination with a crowned E key. Bb Guard. Metal tubes extending into the bore in the finger holes of the wing and boot joints to prevent water from entering the tone holes. All posts are set with epoxy and spring posts are locked with screws.
Body: Red Maple, selected for tone quality, naturally aged in our own facilities. Natural rubber linings in the wing joint and small bore of the boot joint. French bell (metal ring). Body Lock.  Complete re-pad and service done by Fox summer 2010.  Accessories:Fine plush-lined case (original).
