On behalf of the membership of American Federation of Musicians Local 1000, I want to extend our condolences to the families of the miners lost in the disaster at the Upper Big Branch Mine (UBB) in Montcoal, West Virginia. The twenty-five miners who lost their lives, the four still missing, their families, and their entire community are in our prayers and in our thoughts.
     But condolences are not nearly enough of a response to this preventable tragedy. Men and women working in twenty-first century America should not have to worry that there is no recourse for their concerns about workplace safety. For years the Upper Big Branch Mine and its owner, Massey Energy Company, have been cited for numerous violations, especially for high levels of methane and coal dust, the frequent cause of the kinds of explosions that occurred this Monday at UBB.
     Even in news reports today surviving UBB miners asked for anonymity when relating past safety concerns for fear of losing their jobs. Non-union miners have no protection in such matters. And non-union mines have no leverage for pressing for the safety of those who mine our coal. To put this into perspective, the miners who died at the Sago, WV mine in January 2006 were working in a non-union mine on a federal holiday. There wasn't a union miner in America working that day until they reported for the rescue team at Sago.
     Nor are words or outrage a sufficient response to West Virginia's latest sorrow. We at Local 1000 pledge our membership in support of organizing drives in our nation's coalfields. We will be there both in spirit and in person to walk the lines, to play at the rallies, and to support our sisters and brothers in their efforts to save their families, save their jobs, and, as has been proven to be literally the case, save their lives.
     We call on all our brothers and sisters in the American Federation of Musicians, all union members across this great nation, and all people of good will to pledge the same. We can help prevent future disasters by helping workers organize and win the kind of protection only unions can give working people. It's been proven that the companies won't do it. It's been proven the government can't do it. And history has proven that we can do it.

Performance Rights in Sound Recordings

In 1978 a report titled, "Performance Rights in Sound Recordings," was created by a subcommittee of the House of Representatives Judiciary Subcommittee on Courts, Civil Liberties, and the Administration of Justice.  I shared it with members of the International Executive Board in 2009 and each one found it informative and educational.  I have included a link to that report at the bottom of this e-mail.
    The fifty-five page report was initially created to provide information to Congressional legislators on a bill then being considered that would provide for performance rights in sound recordings.  
    One section of the report is entitled "The Taft-Hartley Act, the Recording Ban of 1948, and the Creation of the Music Performance Trust funds." This report also gives a thorough description of the events leading to the creation of the "Guild" that was comprised of recording musicians in Los Angeles.  It speaks to representational issues, bargaining issues, dual unionism, and other pertinent topics.  
    The report also highlights "Petrillo's preference for the unemployed musician" and his "preference for collective bargaining rather than the law." In effect, rather than working for a legislative solution to the use of copyright recordings, Petrillo chose to attempt to negotiate payments from the record companies. Additionally, Petrillo was concerned about unemployed musicians and finding money to pay them rather than organize more work for the unemployed.  
    Today's Federation, through national legislative action, attempts to achieve what cannot be achieved through collective bargaining and/or national strikes. At the same time, the Federation understands that organizing new work must be a top priority and continues to be committed to organizing work for unemployed musicians and those who are currently employed but are working without the benefits and protections of a Federation agreement.
While the length of the report makes for substantial reading, the International Executive Board and I found it to be an important supplement to the history of the AFM and we hope that you will also find it of great value.

Trumka Warns 'Forces of Hate' Fanning Flames of Workers' Economic Anger

A failed economy that only seems to work for a privileged few is fueling rising worker anger. In a speech at Harvard University last night, AFL-CIO President Richard Trumka warned there are "forces of hate" at work who "seek to divide working people--to turn our anger against each other." The only way to fight the forces of hatred is with a strong progressive movement. Also yesterday, CNN named Trumka one of the "Day's Most Intriguing People."

      The Golden Eagle Concert Band, an IRS 501(C)(3) non-profit organization is a  50 piece adult community concert band has the following openings: We desperately needs Bassoons. We also have openings for 4th French Horn, Trombone - Assistant 1st; Clarinet; and Percussion - Mallets.

Quiet Song for Band- Grade 1/2, by Debbie Davidson.
 A great song for the first band concert of the year! It uses the first five notes typically used in band method books, and is inspired by "Bolero." A quiet tune begins with the flutes and then gradually all of the instruments are added for a big climax before it tapers back down to the flutes. Sure to be a crowd-pleaser!
