NHOHVA Legislative Update: 

fish and gameOn Wednesday, March 27, NHOHVA attended a public discussion at the NH Fish and Game headquarters regarding new rule proposals.  The rules discussed were lableled "Fis 1501.01, 1506.01 and 1509.02" and the short title reads "OHRV and snowmobile event permits; wheeled vehicle reciprocity with VT." 

 

One proposed rule change will add a definition of the word "event" as it pertains to OHRV pursuit.  The difinition will read as follows: 

 

"'Event' means an organized OHRV or snowmobile race, rally, contest, antique or defined charitable meet in which OHRVs or snowmobiles are operated within a designated set of boundaries, trails or prescribed course, upon public or private land or frozen bodies of water owned by anyone other than the organizer of said event but does not include trails maintenence projects or other OHRV or snowmobile gatherings." 

 

Along with the new difinition of "event" comes a permit requirement under proposed rule FIS 1506.01.  These rule changes will increase the burden placed on the permit applicant and add a misdemeanor criminal liability for any false statements made in the application process. 

 

Also discussed was a proposed rule change to allow wheeled Off-Highway Vehicles properly registered in the state of Vermiont to operate on wheeled-vehicle state-owned trails in New Hampshire.  This is a temporary rule change that will sunset in 2013, so that means Vermont-registered machines can only ride New Hampshire state trails from May 23 to December 1 in 2012 and 2013 only. 

 

This proposed rule change is made with an eye on improving economic conditions in the north country.  The thought is to try it for two years and keep an eye on how much money this change will bring to north country businesses.  There are over 100 OHVs in Vermont that are registered in New Hampshire consistently every year.  New Hampshire Fish and Game is willing to take a diminution in revenue and sacrifice those registration dollars in an attempt to improve the current north country economy.   

 

Threats Remain Around the Country

The threat is not just to our sport.  Is is not just an attack on ATVs and dirt bikes.  It is an attack on outdoor recreation.  It is an attack on the way we live our lives in America.  The things we have come to love are being sold out from under us in the name of saving the planet.  Soon if the political trend in this country continues the way it is currently going you will not have an OHV to ride or a place to ride it.  
 

 

Think you're safe because you live in NH and our state still offers places to ride? Wait until you're informed that if you partake in an activity that might be construed as dangerous, like riding a dirt bike or ATV, new insurance regulations might have just left you uncovered. You might be automatically denied medical coverage.

 

Or how about this one - you may no longer be allowed to modify your OHV machine.  Or car, truck or boat. It could soon be illegal for companies to produce, sell or install any aftermarket parts unless they meets stringent EPA policy guidelines that are prohibitively difficult for small businesses to conform to, not to mention additional state-mandated regulations that are even more complex. And this does not just apply to your ATV or dirt bike; sweeping regulations are planned for your car, truck, lawn mower and leaf blower - and that is just the beginning of what the future could hold.

 

Don't let this trend come to New Hampshire! Your help is needed now more than ever! We need to start doing something about it right now and the solution begins with every one of us.  And it starts with controlling excessive noise, but it does not end there.  If you ride in NH, then you should be in a NHOHVA club.  NHOHVA clubs are recognized for their commitment to promoting a positive image of our sport here in NH and beyond.

On the NHOHVA Docket
 

NHOHVA is fighting for your right to ride!  NHOHVA is keeping a vigilant eye out for any potential threats to our sport here in New hampshire and around the country.  Our work is never done and we will never rest!  These are some of the issues NHOHVA is currently working on and where we stand with each issue.

 

Remember NHOHVA is here working for you and your right to enjoy our sport. Here is the procedural posture of a few of the items on our docket:

  

  • SB0366-FN - relative to use of certain OHRV's on snowmobile trails and relative to authorization for snowmobiles and OHRVs registered in Vermont and Maine to operate in this state
    • A public discussion on the amendments to this bill will also be discussed on March 27, 2012 in Concord, NH.  NHOHVA will testify before the New Hampshire legislature at this meeting on behalf of all OHV users in the state. 
    • NHOHVA supports this bill as originally proposed but we do not support the recent amendments made to allow ME and VT riders to ride NH trails without registration in NH without a reciprocal agreement from those states. It is NHOHVA's position that out-of-state riders with out-of-state off-road registrations should not be allowed to ride NH trails without a reciprocity agreement from that state. Currently ME and VT do not allow wheeled OHVs on their state trails with a NH off-road registration only - a second registration is required for those states.
  • SB0250 - relative to operation of trail bikes and ATV's on state lands
    • This bill attempts to allow ATV trails in Coos County to interconnect. 
    • This bill was referered to Resources, Recreation and Development on March 8, 2012.
    • This bill will also be discussed on March 27, 2012 in Concord. 
  • SB0237 - relative to field purchases and transfers of funds for the state park system and the bureau of trails, and the use of gifts and donations to the division of parks and recreation
    • This bill was referred to resources, recreation and development on February 22, 2102 and a public hearing was held on March 12, 2012 in Concord. 
  • HB1540 - relative to conservation easements on public land
    • This bill was put on hold on February 15, 2012. 
  • HB1442 - relative to motorcycle noise emissions regulation
    •  This bill was introduced and referred to transportation on March 7, 2012. 

  • HB1332 - relative to the law enforcement authority of fish and game officers
    • 2/22/2012 - with a vote of 181 to 165 this bill ought to pass
  • HB1337 - relative to the enforcement of violations of fish and game laws and establishing a committee to study the disposition of wildlife confiscated by the fish and game department
    • 2/22/2012 - this bill has been deemed inexpedient to legislate and put on hold
Upcoming Events

 

March 27 - Concord, NH - 10:30AM - Legislative Office Building - Room 203

Public hearing discussing amendents made to HB0366 allowing ME and VT OHV users to have access to NH trails without a NH off-road registration. 

 

NHOHVA will be in attendance and we will be testifying before the NH Legislature on this issue speaking on behalf of our member clubs and OHV users in the state of NH. 

 

Please Join NHOHVA in support of our position opposing these amendments.  Join NHOHVA and send a message to the NH Legislature that the OHV users of this state support the bill as proposed but not the bill as amended.

GNCC Update
 
The next stop on the GNCC tour brought riders to the Aonia Pass MX Park in Washington, Georgia just a few short days after battling it out in the rough Florida sands. 

Once again Chris Borich took home the first place prize giving him a total of 60 points so far in the season in his XC1 Pro ATV Class.  Chris has an early lead over Walker Fowler with 39 points, but it is still very early in the season. 

Congratulations to local talent and NHOHVA members Shawn Levesque for finishing 6th place in the 200A class and Dan Goncalves for coming in 6th in the 4 stroke A lites class.
