On 9 July 2012, important changes to mandatory reporting of sexual abuse for schools were due to commence. However, the Minister for Education, Training and Employment has recently announced a partial deferment of these changes, with the remaining changes still to commence on 9 July 2012.

Trust Deeds ... updating needed

We are regularly updating Discretionary / Family Trusts and Testamentary Trusts to adopt new best practice provisions to provide the trustee with the flexibility needed to appropriately maximise net tax benefits for the beneficiaries.

Amendments often include - a new definition of income to include gross capital gains; ability to adopt different definition of income in any income year (by trustee resolution without amending the trust deed again); and the ability to pass distribution resolutions after the close of a tax year within such further time as is administratively allowed by the ATO.
