Being Professional:

Sometimes, in our haste to make a sale we forget that everything we do reflects upon us andJ. Bryan our profession either positively or negatively.  As Professional Standards Chair I sometimes hear complaints that make me shudder to think of how the public perceives us.  Recently, an agent told me about two incidents of a Buyer's agent calling to ask if the Sellers of a home would pay a higher commission to the Buyer's agent. There is nothing wrong with that.  It was the next comment that is totally unethical: "If they won't pay more, I won't sell the home! [write up the offer]"  Many agents have also reported that they get calls that other agents will not show their homes if their co-op commission is too low.  As a reminder to all of our agents; when we are acting in our client's best interests, we should not be motivated by our own compensation.

Certainly, refusal to write an offer is a violation of Standard of Practice 16-16:

REALTORS®, acting as subagents or buyer/tenant representatives or brokers, shall not use the terms of an offer to purchase/lease to attempt to modify the listing broker's offer of compensation to subagents or buyer/tenant representatives or brokers nor make the submission of an executed offer to purchase/lease contingent on the listing broker's agreement to modify the offer of compensation. (Amended 1/04)

Professional actions sometimes require thought and review.  If you would like to explore some of the areas that might be questionable; please contact me via email and I will be happy to add topics to our weekly GCHAR REALTOR bulletin.
