1035 Exchange from an Annuity to LTC insurance

Many of the Long Term Care (LTC) provisions of The Pension Protection Act of 2006 (PPA) went into effect on January 1, 2010. These new provisions expand the planning opportunities in the LTC, life insurance and annuity markets. Previously, funds could be 1035 exchanged into annuity products from life insurance products, but could not be transferred out with out incurring tax consequences. The PPA allows LTC premiums to be paid in a tax-advantage way through a 1035 exchange from annuity or life insurance cash values. In order to take advantage of the tax benefits, the LTC policy must be qualified, and the benefit can not exceed the greater of the actual cost of long term care or that year’s daily benefit prescribed in HIPAA.

  • What was the purpose of the original life insurance policy?
