How to plan despite uncertain tax laws

Many planners and clients are finding it difficult to know how to plan when the estate tax laws are so uncertain. There is currently no estate ore generation skipping transfer tax and the gift tax rate is 35% with a $1 million lifetime exemption. However, this is scheduled to change in 2011 and no one knows which direction it will go in. Does this mean that people should not plan until they know what the changes will be? Absolutely not. Despite how the taxes will change, the benefits of planning remain important regardless of the outcome. Life insurance will continue to offer family protection, survivor income, wealth transfer and business succession planning. Procrastinating life insurance could result in higher costs, loss of insurability due to health issues and possible decrease in product choices. Life insurance trusts will continue to protect proceeds and additional trust assets from possible creditor problems, divorce, or irresponsible spending. Wills, trusts and beneficiaries should be reviewed annually to ensure that the clients plans and goals are accurate.
