Good News about SEC Rule 151a

On Monday, July 12, 2010 SEC Rule 151a (the case of American Equity v. SEC No. 09-121) was vacated by the United States Court of Appeals for the District of Columbia. The order deleted the third paragraph, 572 F.3d at 936 and replace a paragraph that included a statement that "Having determined that the SEC's § 2(b) analysis is lacking, we grant the petitions insofar as they assert the SEC failed properly to consider the effect of the rule upon efficiency, competition, and capital formation." And that "The SEC argues it is likely to reissue Rule 151A but it also acknowledges it is in the midst of analyzing the effect of the rule upon the law of each state."

This is great news for the Fixed Indexed Annuity industry as this is a huge step in keeping FIA's from becoming securities. However, it is important for Registered Reps to realize that although FIA's may not be made into securities, many Broker Dealers do have individual rules concerning the sales of FIA's and it is important to follow these regulations.

The Value of Time Management

No matter how hard we work, it is sometimes difficult to get everything done. There are many time management books, classes and programs to help people to get the most out of their time. Here are some comparisons on how time management is similar to financial planning.

  1. Create a budget. Similarly to creating a financial plan, create a "time budget" by itemizing your schedule into blocks.
  2. Pay your self first. Just like any good investment plan puts money into saving first, it is important to block out time for your self. When you know that this is your designated time to work out, spend time with family or friends, or do other personal activities, then you do not feel guilty or that you should be working. This also allows you to focus more on work as you know that your personal time has been scheduled.
  3. Prioritize. Bills must be paid before luxury. Time for important clients, goals and events should be scheduled first. Everything else can fill in the gaps.
