Yahoo Password Breach Includes Gmail, Hotmail and AOL Users

At least 400,000 email addresses and passwords of Yahoo users were stolen and revealed by hackers, Yahoo confirmed. The hackers, who called themselves the D33Ds company, posted a full text document online containing the usernames and passwords, and said that it should be a "wake-up call" rather than a threat to Yahoo. "There have been many security holes exploited in webservers belonging to Yahoo Inc. that have caused far greater damage than our disclosure," they wrote.

Yahoo said only five percent of the username-password combinations revealed were still valid or current. However, it wasn't just Yahoo email addresses in the document. Some of the Yahoo Voices' accounts listed email addresses with AOL, Gmail, Hotmail and Windows Live.

Security firm Sucuri said that more than 100,000 Gmail addresses were included in the breach

You can imagine that at some point Yahoo may be sued by Gmail, Hotmail and AOL for exposing their clients' information. Cyber Liability insurance can help  pay to defend and settle these types of third party liability suits.

LinkedIn Hit with $5M Lawsuit over Security Breach

LinkedIn has been slapped with a $5 million lawsuit in the wake of the mass password theft it suffered earlier this month. The class action seeks damages for negligence and breach of contract.

One of the key points in the case is LinkedIn's failure to "salt" password hashes before storing them on its servers and in using an "outdated" hashing function for security. Salting is a process that adds an extra layer of encryption to hashed data, and is particularly useful in helping to prevent against common hacking methods.

Another point of contention in the case comes from preliminary reports that the 6.5 million passwords were stolen from LinkedIn through an SQL injection attack.  Such an attack exploits security vulnerabilities in a website, which could mean that LinkedIn was not taking sufficient security precautions.

LinkedIn claimed that there have been no reports of members whose accounts were breached from the stolen passwords.

Once again, Cyber Liability insurance would be a very important coverage to have in this situation.

Independent Contractor or Employee?

One of the toughest questions for our clients is often determining whether a worker should be classified as an employee or independent contractor for Workers Compensation Insurance. The short answer is that when in doubt, consult a labor attorney. But Best's Review magazine recently ran an article that at least helps with understanding the issues involved in this determination.

According to the article, the most important factor is whether the company has the right to control the manner and means by which the worker accomplishes the desired result. In other words, does the worker manage their own work process.

Secondary factors include:

  • Whether the worker is engaged in a distinct occupation or an independently established business.
  • Whether the worker or the company supplies the tools or instrumentalities used in the work.
  • Method of payment, whether by time or by job.
  • Whether the work is part of the regular business of the company.
  • Whether the worker has a substantial investment in the business.
  • Whether the worker hires employees to assist him or her.
