Popularity of Pop-up Stores Continues into 2010 Holiday Season
 
Build A Bear LogoBuild-A-Bear Workshop announced recently that it plans to open 10 temporary pop-up stores for the holiday season, starting this month. This followed a Toys "R" Us announcement of plans to open 600 temporary stores in malls and shopping centers for the 2010 holiday season. Toys "R" US will also open another 10 temporary stores featuring its high-end FAO Schwarz brand.
 
Carson Pirie Scott and Calvin Klein recently opened a pop-up shop in Chicago's River North neighborhood, a first for both companies. The 1,600 square-foot store is intended to remain open for only seven days and showcase Calvin Klein's fall collection of sportswear, dresses, jeans, underwear and accessories.
 
Further, Borders Group Inc. plans 25 temporary stores nationwide.

Our Continuing Series: Unpredictable Business Lawsuits
 

Though her own lawyer admits it's akin to "suing Santa Claus," a 75-year-old woman has filed a lawsuit against the

Philadelphia Phillies' mascot (the "Phillie Phanatic") in civil court. She says the Phanatic caused a few injuries during a run-in at a minor league game in 2008 and she's seeking in excess of $50,000 in damages.
 
The plaintiff claims that she was at a minor league baseball gamePhillie Phanatic with her church group when the massive, green, bird-anteater hybrid climbed through the stands and onto her legsIt set off the arthritic process, and in fairly short order she needed a lot of medical treatment. Ultimately, she needed to get knee replacements.
 
The Philadelphia Daily News reports that the Phanatic has been successfully sued on three previous occasions, including an instance where one man was awarded $2.5 million after claiming he was injured by a Phanatic bear-hug at the opening of a paint store in 1994.

Firefighter Dies Battling Restaurant Grease Fire in Chicago
 

A 31-year-old Chicago firefighter died after falling from a ladder while responding to a fire at a downtown restaurantFire officials say the firefighter was carrying about 75 pounds of equipment when he fell about 35 feet while responding to a grease-chute fire at Avec Restaurant on August 9th.

 

The restaurant remains closed. Restaurant

management has secured three of the five permits needed to make repairs to the roof and other alterations. 
 
The restaurant's interior was undamaged in the fire, and management hopes to re-open by mid-October.

California Store Pays $550,000 Fine for Discouraging Workers Comp Claims

 

An investigation determined that managers at a California grocery store regularly suggested that employees turn to their own health insurance for work-related injuries rather than filing workers comp claims. Nearly all states require that employers provide worker comp insurance to cover work-related injuries and diseases.

 

The store agreed to pay $550,000 in fines and investigation costs, plus $30,000 to an education fund, plus potentially an additional $150,000 for any violations within the next five years.

 

It is important to know your responsibilities under workers comp laws in your state.
