Notice Required... Special Enrollment Opportunities and More Grandfathered Plan Status, Adult Child Coverage, Lifetime Limits and Patient Protections

The Patient Protection and Affordable Care Act (PPACA) includes provisions requiring employer-sponsored group health plans to provide certain notices and special enrollment opportunities. Among the required notices are a "Grandfathered Plan Status" notice in order to maintain a grandfathered plan, special enrollment notices regarding the Adult Child Dependent Extension to age 26 and the Elimination of Lifetime Coverage limits, as well as Certain Patient Protections required for "non-Grandfathered" plans.
GRANDFATHERED PLAN STATUS
In order to maintain a "Grandfathered Status", a plan must include a statement, in any plan materials describing the benefits provided under the plan (i.e. open enrollment notices, SPDs, etc.), that the plan believes it is a grandfathered health plan within the meaning of section 1251 of the Patient Protection and Affordable Care Act and is therefore not subject to some of the consumer protections of the health care reform law.
