Legal Spring Cleaning
Spring cleaning typically signifies dreaded house cleaning. However, at this same time of the year when you mopping, sweeping and washing, its not a bad time to do some legal spring cleaning.
Take this time to review all your legal documents, wills, trusts, health care documents and the like. Determine if you have your current insurance policies. Make sure you have photos and/or a written inventory of the contents of your house. Hurricane season is right around the corner. In the event of a claim, you must prove to your insurance carrier the contents of your dwelling. Do you have a valid Power of Attorney? What about an Living Will or Designation of Health Care Surrogate?

Professor's Last Words of Wisdom
Last fall you may have heard the story floating around the internet about Carnegie Mellon University Professor Randy Pausch. After announcing his returement from Carnegie Mellon, he agreed to give a "Last Lecture" a tradition among departing faculty. However, after areeing to give his lecture, he learned that the was diagnosed with terminal pancreatic cancer. The cancer was terminal and he was given only months to live.
While it would have been easy to cancel the last lecture, Pausch elected to give the lecure so that his young children could later appciate his wisdom and his advise for life. Pausch shared seven simple rules that he came to live by:
*Always Have Fun
*Dream Big
*Ask for What you Want
*Dare to take a Risk
*Look for the Best in Everybody
*Make Time for What Matters
*Let Kids Be Themselves
Today, Randy is continuing to spend time with his famly. His last lecture resonated with so many people and afforded Randy the opportunity to fulfill a few childhood fantasies, like playing football with the Pittsburg Steelers and acting in the new Star Trek movie. In honor of Pausch, we challenge you consider incorporating one of his rules into daily like. |

When Insurance
Claims Can Hurt You.
Everyone assumes that insurance is meant to provide security and to meant to make you whole in the event of an accident or property damage. However, sometimes making an insurance claim can actually hurt you.
In the case of an auto accident that is not your fault, you are better off reporting the claim to the carrier for driver of the car at fault. You should put your insurance carrier on notice of the accident, but let them know that you are seeking insurance benefits from the liable party.
Next, when you file an insurance claim and it is covered or denied, that claim does not disappear. Rather insurance companies maintain databases that store information on claims. There are a number of databases: ISO Claim Search, CLUE and A-PLUS. ISO stands for Insurance Services Office, CLUE stands for Claim Loss Underwriting Exchange and A-PLUS stands for Automated Property Loss Underwriting System. Information regarding the type of the loss and how it was resolved are included within these databases. This information is frequently used in connection with underwriting new polices or even in the claims investigation process. One claim will not typically be a problem for insureds. However, multiple claims over a two year period will cause carriers to scrutinize an application. The good news is that claims which result from weather or catastrophes are not held against insured.

Mortgage Foreclosures Hit Record High
As you have likely seen profiled in the local news media, mortgage foreclosures have hit record levels. In 2007, more than 1% of all homes were in some stage of foreclosure. In 2006, only 0.58% faced foreclosure. Here in Florida 2% of all households are entering some stage of the foreclosure process, with 165,291 total properties entering foreclosure. These alarming statistics are a result of the subprime lending practices of many defunct lenders.
In December of 2007, foreclosure filings had jumped 97% from one year ago, indicating that the troubles for many lenders may be just beginning. Who is at fault for the foreclosure crisis? Recent trends in mortgage underwriting have changed lending as we know it. Lenders took unreasonable risks on what had been non-performing borrowers. Lenders offered borrowers more money that they actually should have qualified for. "As stated" income applications were approved and borrowers could not make hefty payments that resulted from this over lending. Finally, mortgage fraud resulted in a segment of non-performing loans. The FBI recently indicated that Florida was a hotbed of mortgage fraud.
As a result of this crisis, lenders have become very conservative as they try to mitigate their global losses. |
