Frequently Asked Questions (FAQs) |
I lost my notary seal. What should I do?
The state does not have a policy regarding lost seals since the notaries are liable for keeping their notary tools secure. It is suggested that if you lose your seal or it is stolen, change the ink color and shape of your seal. For example: if you are using a rectangular state-seal black ink stamp and it is lost, then start using a round blue ink stamp. Make a notation in your notary journal (not required but recommended) of the change.
Do I have to administer an oath in a jurat?
For any notarial act that includes the words "sworn" or "affirm" an oath must be administered by a notary. In administering the oath, the notary MUST require that the person taking the oath swear or affirm that the sworn statement is true and correct to the best of that person's knowledge. Reminder from the Notary Division:
The Notary's Function is to act as an official, unbiased witness to the identity and signature of the person who comes before the notary for a specific purpose.....The key function is to be certain that the person appearing before the notary is who that person claims to be.....Notaries must be constantly aware that every notarial act affects the legal rights of others. Carelessness or negligence by the notary may injure these rights. Read more details: Refer to VA Notary Handbook, p. 3
