Seven Items of Standard Information
Use of an Official Notary Seal = Number 7
 
One of the 2008 changes effective 07/01/08 was the requirement that an official notary seal be used on every document notarized.   Prior to July 1, 2008, the use of an official notary seal was not required.  If one chose to use a notary seal it was required that it be a permanent photographically reproducible image.  Many notaries chose self-inking or pre-inked notary stamps.
 
For those of you who prefer using an embosser, you goldfoilare required to darken the raised seal with a pencil, carbon paper, charcoal stick or impression inker.   You can also emboss over foil stickers which are photographically reproducible.
 
Remember that there are seven (7) items of standard information required in every notarial act which are
1)  Notarial statement
2) The date of the notarial act
3) The place of the notarial act
4) The expiration date of the notary's commission
5) Notary's signature
6) Notary's registration number
7) Notary's seal/stamp

Can I notarize a photograph?  
 
 A Virginia notary does not have the authority to notarize a photograph.  Remember you are notarizing a person's signature.
 
In 2005 Colorado approved Pictorial Notaries who can electronically notarize a photo.

Can a title company make changes in my notarial certificate?
 
No.  Only a Virginia notary can make changes in his/her notary certificate area.  Even though the title company may have a power of attorney to correct clerical errors on documents that the borrowers sign, it does not apply to the your notarial certificate.
 
Recently a signing agent received a document that the title company required the notary to sign.  It read:
 
"I give permission for (name of Title Co.) to make changes to the notary certificate.

Signed: _________________________ (name of Notary)"
 
Do NOT agree to having anyone make changes in your notary certificate.

Reminder from the Notary Division: 
 
Many notaries are still not using a notarial seal on their documents.  Only July 1, 2008, Virginia Notary Law was updated to included the mandatory use of a sharp, legible, permanent and photographically reproducible notary seal on each notarization.   Refer to VA Notary Handbook, p. 8
