2008 Changes In Virginia Notary Law
Several changes will go into effect July 1, 2008

Notaries will not receive individual notifications of this year's changes.   The changes will be posted to the Notary Registration Home Page at the end of June.    courthouse

Expect to see changes in the following:

Notary application - the recommendation process is changing.

Loose certificate change -  Currently notaries are required to notarize on the same page as the signer.  Effective July 1, 2008 :  The law says under prohibitions:  Notarize a signature on a document without notarial certificate wording on the same page as the signature unless the notarial certificate includes the name of each person whose signature is being notarized.
The changes to the Notary Handbook will be posted soon.

Frequently Asked Questions (FAQs)
What is the legality of documents where "State of Virginia" is used as opposed to "Commonwealth of Virginia" in the venue?

Thousands of forms have State/County/City prepared in the Notary Certificate.    It is acceptable to use State.   When there is a choice of State/Commonwealth, you may choose to underline Commonwealth since Virginia is a Commonwealth.question

Can the company I work for require the use of a Notary Journal?

Notary journals are not required in Virginia although we highly recommend the use of one.    Your company can require its employees to use one if they decide to make it a company policy for Employee Notaries.

Driver's licenses will be valid for 8 years

Starting July 1, 2008, Virginia state driver's licenses will change from a 5 to 8 years validation.

The cost of the license will remain the same at $4.00 per year.

The DMV's goal in implementing this change is to reduce traffic at customer service centers (CSC).  You may renew on line as well.  Additionally every other renewal will require you to visit a DMV CSC in order to have your photo renewed and to take a vision screening.

Pay close attention to the details in the license when accepting it as ID.   A person in year 9 of their "on line" renewal will have a photo that may look completely different than he/she does at the time of the notarization..  If you are not satisfied with the ID, ask for another one.  Remember you can always refuse to notarize a document if the ID is questionable.

The Non-drivers identification cards will remain valid for 5 years.
For more details on other changes at the DMV visit their website.
