Is the State Cheating Seniors and People with Disabilities?
We are noticing a disturbing trend with some of the local county Department of Services (DSS) offices when it comes to the NYSARC, Inc. Community Trust II (Pooled Income Trust) and Net Available Monthly Income ("NAMI") payments.
Some local DSS offices are insisting that the NAMI continue to be paid to them, even though the Pooled Income Trust has been approved, until they receive a decision from their own Disability Review Team deeming the applying person to be disabled.
The NYSARC, Inc. Community Trust II was established pursuant to federal and state law and is designed for a person who is disabled to protect his or her resources and income in order to be eligible for governmental benefits. This program is available to citizens who are disabled and are applying for the Medicaid Home Care Program and have an income surplus that they would like to be able to access for their own living expenses and services not covered by Medicaid.
Once the individual who is disabled is accepted by NYSARC, NYSARC will accept the surplus income while the Medicaid application is pending. Medicaid eligibility will be retroactive to the date the sub-account with the Pooled Income Trust.

In September 2009 the Theresa Foundation celebrated the Opening of Theresa Academy for Performing Arts (TAPA). TAPA embraces all of the performing arts. Students are able to take classes in a safe, non-judgmental environment, and create and explore the arts at their own pace to the best of their abilities.
