All U.S. employers are responsible to verify that new hires, including those who are non-citizens, are eligible for employment in the U.S. by the completion and retention of Form I-9. Employers must use Form I-9 to record their review of acceptable employment eligibility and identity documents presented by the employee.  Changes have been made to the list of the documents that are acceptable for use as verification of eligibility for employment.
 
Effective Date:  Originally employers were required to begin using the revised Form I-9 on February 9, 2009.  However in a notice published late on January 30th, the U.S. Citizenship and Immigration Services (USCIS) changed the effective date to April 3, 2009.  All employers are required to use the revised Form I-9 for new employees hired on or after April 3, 2009, but the current version of the Form I-9, dated June 5, 2007, must be used until that date.

Worker, Retiree and Employer Recovery Act of 2008 (H.R. 7327)
Signed into law on December 23, 2008
 
The bill, H.R. 7327, includes important short-term relief provisions to help individuals and plan sponsors with management relief during the market downturn.  The bill also includes a number of important provisions that could not be reflected in guidance until technical corrections had been enacted, including giving the Treasury Department the authority to write rules for small defined benefit plans with end-of-year (EOY) valuation dates regarding benefit restrictions and quarterly contributions. Family and Medical Leave Act
Changes & Additions
The Family and Medical Leave Act was expanded, for the first time since its inception in 1993, by the National Defense Authorization Act (P.L. #110-181) to include two new categories of leave for FMLA eligible employees:

  • Up to 12 weeks of job protected leave when a family member is on, or is called to, active duty. This is called "Military Exigency Leave".
  • Up to 26 weeks of job protected leave for those who are taking care of for a family member who sustained an injury or illness in the line of military duty. This is called "Military Caregiver Leave".
