DOT Publishes Final Rule - Effective October 1, 2010
As published in the August 16, 2010 Federal Register, effective October 1, 2010 the Federal Regulation 49 CFR Part 40 Procedures for Transportation Workplace Drug and Alcohol Testing Programs will include rule changes that will impact federally regulated drug testing programs. Clinic Shy Bladder and After Hours Protocols
Employees (also referred to as "donors") may not always be able to produce a urine specimen for urine drug testing upon arrival at the collection site. When this occurs, the employee is allowed three hours to provide a specimen, and can consume up to 40 ounces (5 cups) of water while they wait. This is sometimes referred to as a "shy bladder", and the collection site will use separate documentation to assure the proper procedures are followed for each donor. There are other circumstances which would require that another specimen be provided, such as a specimen that is out of temperature range, or appears to have been tampered with. In any of these cases, the patient is allowed three hours to provide another specimen as above or be considered a refusal to test if no specimen is provided. Click here to read full article.
