Yes. Any person who has a vehicle in Florida for more than 90 days during a 365-day period must purchase personal injury protection and property damage liability insurance coverage. The 90 days do not have to be consecutive.

Specialty Insurance Agents Association is supporting you the local agent. We have written articles showing what we have accomplished. At this time we continue to push our flood program with National Group that will pay you  20% for new business and 20% for renewal business. I am aware of several companies that will pay 20% (if you are lucky enough to get a rep to offer  you that much) on new business, but don't know any that will pay you 20% on renewals. There are many changes in the flood program for 2009. The main one is a premium increase for new and renewal business.
 
The two policies available in the flood program are 1- the Preferred Risk Policy. This is for homes or renters living in a B, C or X zone. One of my employees suffered a flood loss while living in a X zone without flood insurance. The drainage system backed up below her rented home and as a result the property was flooded with substantial loss to her contents. Although we don't sell many Preferred Risk Policies, we do sell some and make 20% on each one. 2- The Standard Policy for homes located in the other flood zones, A & V zones. The standard policy premium almost always exceeds $500 per policy. Our agency have many clients who have their homeowners policy with another agent and we have the flood policy. There are many reasons this can happen, but the point I am trying to make is that you are writing many policies for many people and some of them are buying flood insurance (that is paying 20% commission to the flood agent) from another agent. If  you let all your customers know that you now have flood insurance available, you would start selling flood insurance.
 
The  flood insurance policy is written through the National Flood Insurance Program, administered by FEMA. You do not have to be appointed by a homeowners company to write flood insurance. This is a very easy program to write, the software program is easy to use and there is help available by internet or by phone. A real person will help you with rating a policy or policy service. If you are not joining our program, both of us are losing.
 
Here is a summary of the pending changes to the flood program:
 
NFIP Program changes have historically been released in the month of May, and therefore the upcoming
October changes are extensive due to the NFIP's late release. NFS StoneRiver is fully prepared to
implement these changes and insureds should not experience any delays in the processing of their
renewals post October 1st. The following document provides a summary of the NFIP October 1st, 2009
Changes.
Premiums will increase an average of 8%. The extent of the rate increase varies by zone:
V Zones - (coastal high-velocity zones) larger rate increases are being implemented again this year as a
result of the Heinz Center's Erosion Zone Study, which clearly indicates that current rates significantly
underestimate the increasing hazard from steadily eroding coastlines. Premiums will increase 10%.
A Zones - (non-velocity zones, which are primarily river line zones)
· Post-FIRM A1-A30 and AE Zones: Premiums will increase 10%.
· Pre-FIRM AE Zones: Premiums will increase 10% to slightly decrease the amount of subsidy in our
Pre-FIRM rate.
· AO, AH, AOB and AHB Zones (shallow flooding zones): Premiums will increase 8%.
· Unnumbered A Zones (remote A Zones where elevations have not been determined): Premiums will
increase 10%.
· A99 Zones (approved flood mitigation projects, e.g., levees still in the course of construction) and AR
Zones: Premiums will increase 10%.
X Zones - (zones outside the Special Flood Hazard Area):
· Standard Risk Policy: Premiums will increase 10%
· Preferred Risk Policy: Premiums will remain unchanged
Elimination of $500 deductible for all policies
· Increase of the standard deductible from $500 to $1,000 for all Post FIRM properties
· Increase of the Preferred Risk deductible from $500 to $1,000 for all properties
· Increase to the standard deductibles from $1,000 to $2,000 for Pre FIRM Special Flood Hazard Area
· Note - Existing policies impacted by the deductible changes will be adjusted at the policy renewal
date automatically to $1000. Insured Renewal Notices will include communication informing
insured.
Increases to the Basic policy limits
· Building Limits - Single Family and 2-4 from $50,000 to $60,000; Other Residential/Non-Residential from
$150,000 to $175,000; RCBAP Low Rise from $50,000 to $60,000; High Rise from $150,000 to $175,000
· Contents Limits - Increase in the basic contents limits: Residential from $20,000 to $25,000; Non
Residential from $130,000 to $150,000; RCBAP from $20,000 to $25,000
Presentment of Premium date requirements
The requirements have been defined and clarify what constitutes premium paid at time of closing (i.e. lender's
check, title company's check, or settlement attorney's check) and reinforces timely submission to honor effective
dates. Check dates will be compared to the company received date when premium payment is not part of the
closing.

Florida Electronic SR22 and FR44 Filing Reminder and Updates

 
Since June 30, 2009, all insurers have been required to report filings - SR22/SR26, and FR44/FR46 - electronically in Florida. The paper versions SHOULD NOT BE USED. When an SR22 or FR44 is submitted, it takes 24 - 48 hours from the time of submission for it to show
The state will no longer accept hard copies of the form, so please discard your supply.
 
Additional background
Under Florida Statute 324.023, the filing, an FR-44, requires drivers that have been convicted of driving under the influence (DUI) after October 1, 2007, to prove that they carry higher liability limits. The required limits are as follows: $100,000/$300,000 Bodily Injury liability limits $50,000 Property Damage liability limits or 350 CSL or higher Please be aware that policyholders cannot have: a Florida FR-44 on a policy in a state other than Florida, or more than one FR-44 on one driver or, a Florida SR-22 and Florida FR-44 on one driver. 
 
Therefore, please check underwriting rules before placing coverage  with a particular carrier as they may deny a claim and you may be faced with an E&O situation.

NFIP RATE CHANGES AND MORE 2009
 
NFIP RATE AND DEDUCTIBLE INCREASING OCTOBER 1
 
On October 1, 2009, important changes to the NFIP will take effect. There will be an increase in rates, the standard deductibles, and the basic insurance limits. These combined changes will result in an average premium increase of 8 percent . Many policyholders will have questions about these changes. To help you best serve your clients, we have developed a number of "answers to possible questions" to help your customers better understand how these changes will affect them.
 
Q: Why are my premiums going up?
A: It is not uncommon for insurance companies to implement annual rate increases to help offset their increased costs, including inflation. The NFIP, like most insurance companies, has found it necessary to implement these important program changes to ensure that current premiums more accurately reflect the current risks.
 
Q: Are the rates increasing to collect the premium dollars that were used to pay for claims as a result of Hurricane Katrina?
A: No. It is a misconception that rate increases happen to offset debts attributed to Hurricane Katrina or any past event. Actually, Federal regulations clearly state that the NFIP cannot raise rates to recoup for previous losses. Simply put, NFIP premiums only reflect expected future losses and expenses. There is no charge contained in the premium to recoup past losses.
 
Q: Why is my deductible doubling?
A: The NFIP's previous minimum deductibles were in place for more than 10 years. The NFIP found it necessary to discontinue the minimum deductible of $500 and increase the new standard deductibles to avoid overall larger premium increases.
It is important to remember, that in most cases the deductible is only a fraction of the average flood insurance claim, which can cost tens of thousands of dollars.
 
Q: Why are the basic limits of coverage on the Standard Flood Insurance Policy (SFIP) for residential and non-residential buildings increasing?
A: The NFIP takes many steps to financially prepare for future flooding. In order to do so, the basic limit of coverage, the level which sustains the most damage in a flood, needs to be brought into better alignment with the typical NFIP paid claim.

If you purchase flood insurance beyond the basic limit, you will receive more coverage at a lesser charge. And, to get full replacement cost for your primary residence in the event of a flood, you must insure your building to at least 80 percent of its replacement value (or $250,000, whichever is less).

Hurricane Checklist: Don't let your guard down, it's not over yet Florida has been lucky this hurricane season; however, that luck should not be turned into complacency. Now more than ever Floridians should be on alert and ready for a disaster.
What should you do to stay prepared?
Check your disaster supplies and replace/restock as needed.
Make sure items and materials outside your home are picked up so they wouldn't be scattered by wind.
If a storm approaches, turn your refrigerator/freezer to the coldest setting and keep the door closed as much as possible so food will last longer if the power goes out.
Turn off propane tanks and unplug small appliances.
What do you do after a hurricane?
Inspect your home for damage and take pictures (keep a disposable camera in your disaster supply kit). Take pictures of your home, building contents and any damage.
Wear protective clothing and be cautious when cleaning up debris.
Only use the telephone for emergency calls. Keep lines clear for emergency personnel.

WHAT TO CHARGE FOR A MVR
 
WHAT SHOULD OR CAN YOU CHARGE FOR AN MVR

Many agents are wondering how other agents are handling charging customers for mvrs.  It's easy to get many different answers.  I've decided to address the concerns and have come up with the following.  Below is a section from the Florida statute.  It is recommended by most that you do NOT charge more than the $8(3yr) or $10(7yr) mvr fee.  Service/access fees to the agency for obtaining the records shouldn't be charged.  Be sure to read all the way to the bottom: 
(5)(a)  A licensed general lines agent may charge a per-policy fee not to exceed $10 to cover the administrative costs of the agent associated with selling the motor vehicle insurance policy if the policy covers only personal injury protection coverage as provided by s. 627.736 and property damage liability coverage as provided by s. 627.7275 and if no other insurance is sold or issued in conjunction with or collateral to the policy. The fee is not considered part of the premium.
(b)  To the extent that a licensed general agent's cost of obtaining motor vehicle reports on applicants for motor vehicle insurance is not otherwise compensated, the agent may, in addition to any other fees authorized by law, charge an applicant for motor vehicle insurance a reasonable, nonrefundable fee to reimburse the agent the actual cost of obtaining the report for each licensed driver when the motor vehicle report is obtained by the agent simultaneously with the preparation of the application for use in the calculation of premium or in the proper placement of the risk. The amount of the fee may not exceed the agent's actual cost in obtaining the report which is not otherwise compensated. Actual cost is the cost of obtaining the report on an individual driver basis when so obtained or the pro rata cost per driver when the report is obtained on more than one driver; however, in no case may actual cost include subscription or access fees associated with obtaining motor vehicle reports online through any electronic transmissions program.
 
 
Again, I hope this information helps your agency stay out of trouble during this "wicked" economy.

NCCI DECREASES RATES
 
Commissioner Approves Proposed Workers' Compensation Insurance Rate Decrease
Marks 7th consecutive year of rate declines
 
 
TALLAHASSEE, Fla. - Florida Insurance Commissioner Kevin McCarty today announced he has issued an order approving the proposed rate decrease submitted by the National Council on Compensation Insurance (NCCI) for workers' compensation insurance rates. The NCCI filing submitted Aug. 20 includes an overall average statewide rate decrease of 6.8 percent beginning Jan. 1, 2010 for all new and renewal workers' compensation insurance in Florida. 
 
The rate decrease will produce an estimated savings of more than $166 million for Florida employers, and represents the seventh consecutive decline in workers' compensation rates since the Legislature passed sweeping reforms. The cumulative overall statewide average is 63.2 percent since the 2003 reforms.
 
"This is good news for Florida employers, and the Florida economy," stated Commissioner McCarty. "Both the Legislature and Governor should be commended for enacting HB 903, which clarified attorney's fees are subject to limitations in response to the Florida Supreme Court decision in the Emma Murray case. If it were not for this legislation, the workers' compensation industry in Florida would likely have proposed rate increases instead of decreases in 2010."
 
Before the 2003 legislative reforms, Florida had the first or second highest workers' compensation rates in the country. Last year, Florida dropped to the 28th highest; the most recent round of rate reductions will place Florida among the lowest 10 states in the country.
 
NCCI, which produces and files rates for insurers in many states, noted the rate decline was primarily due to significant reductions in claims frequency although there are indications this trend has moderated.  The Office conducted a rate hearing on Oct. 6, 2009, and heard testimony from NCCI, industry experts and the public before rendering a decision. 
 
Although the commissioner found the overall rate reduction of 6.8 percent justified, the commissioner did take exception to some of NCCI's methodologies including its calculation of policyholder dividends, cost of capital, investment yields, minimum premiums and proposed roofing rate.  Technically, the order issued today denies the original rate filing. However, the overall rate reduction will be approved when NCCI modifies its current filing. The Office anticipates NCCI will need a few weeks to resubmit this filing; the commissioner will issue a final order at that time.

And They're Off....Will They Offer A Ride Or Run You Over?

The Florida Legislature begin their Interim Committee Meetings in Tallahassee the week of October 5th in preparation for the 2010 Regular Session commencing in March. They will be having monthly meetings in November and December as well with more frequent meetings in January and February. The annual Session starts in March.
 
House Speaker Larry Cretul and the Florida House of Representatives made several changes to their committee structure following last session. (As you may recall, House Speaker was called upon to take the Speaker's office following the removal by the House of Representative Ray Sansom from the position in January leaving very little time for Speaker Cretul to make any leadership changes of his own. He now has.)  However, none of these changes have affected the House Insurance, Business and Financial Affairs Policy Committee.  The House committee did not meet this week as staff is working on various interim reports to present to the Members beginning in November.
 
The Senate Banking and Insurance Committee met briefly this week to hear presentations on the Florida Catastrophe Fund, Citizens Property Insurance Corporation and from the Insurance Commissioner, Kevin McCarty. No earth-shattering revelations occurred and much of the discussion centered around the desire by some to continue pushing for deregulation of rating for certain property policies as outlined by the legislation from last Session vetoed by Governor Crist.
 
SA will be closely engaged in the work of these Committees as we pursue our legislative agenda. Next month's article will be devoted to laying that agenda out. In the meantime, PLEASE continue to provide us with your thoughts and ideas of issues you

We already have a new 2 hour class on agency management approved for the 2010 convention. There are two other 3 hour classes pending. One is a class on homeowners insurance and the second class is on the subject of flood insurance. We are planning on a class dealing with auto insurance and another class on the subject of  Comprehensive General Liability Coverage, the sub contractors coverage. Many of our members sell the CGL policies and need to know more about them. We always have several participants at the TRADE FAIR who offer the CGL policy as part of their programs. It can add to the agencies bottom line. If you are not currently selling the CGL coverage, plan on attending our class and learn how to add it to your product offering for your customers.
 
The homeowners class is based on the subject of the proper coverage's needed by your customers before a hurricane. Action you and your customer should  take before a hurricane. The personal information they need to have available before a hurricane. The claims information you need to share with your customers after a hurricane.  There will be a discussion on  company adjusters, independent adjusters and public adjusters. We will discuss what the mediation process is. 
 
We will have the mandatory classes, 3 hour ethics class and a 1 hour wind mitigation class to meet the requirement for 2-20 agents and a senior annuity ethics class for our life license members. 
 
Our flood class will discuss in depth the flood insurance program. We will discuss what is a flood, the WYO program, the SFHA and who is eligible for a flood policy.
 
The National Flood Insurance Program has a co op program for yellow page ads. If you qualify and by using a NFIP ad, they will pay from 25% to 75% of the yellow page ad cost. We will have information to share with you on this program and how you can make it a part of your budget for yellow page advertising.
 
Last year Progressive, Infinity and Nations Safe Driver participated in our CE offerings for you. We are looking forward to the biggest and best Convention and Trade Fair in 2010 and we are making plans right now to make it be important for you to attend.

Citizens is pleased to introduce Automated Underwriting (AUW) in ePAS for Personal Residential Multiperil (PR-M) policies. Your agency will be activated for AUW in ePAS beginning October 1, 2009. An Agent Training Guide detailing changes can be found in the the ePAS system. 

 
What is the Automated Underwriting Process?
If a new business application submitted in ePAS meets certain criteria, the risk will be Bound and Automatically Approved.
When printed, the application will indicate that it was Auto-Approved.
Agents should retain the completed application and all other supporting documents for audit purposes.
Agents should not mail, fax or electronically submit the application or other supporting documents for AUW applications.
Agents should mail premium and payment transmittal form to Citizens within five (5) business days from the coverage effective date.

Audit Process:
All policies will be subject to an electronic or on-site audit.
Your Agency Principal will receive a phone call from Agent Compliance advising when the audit will take place.
An e-mail notice will be sent to the Agency Principal and the Agent of Record identifying the policies being audited and describing the submission process.
Submit all policy documents to Citizens within one business day of the e-mail notice.  

If an application is not Automatically Approved, ePAS will allow the submission but will assign a status of Bound/Unapproved. The Required Documents screen will display a list of the forms that must be submitted to Citizens to complete the underwriting process.

Applications that have been Automatically Approved cannot be withdrawn, however, they can be cancelled if circumstances warrant. Agents should create a journal note with the details and then upload a memo, letter or other documentation indicating the situation and requesting the policy be cancelled.

How does AUW differ from Single Personal Lines (SPL)?
Many of you may also be involved in the SPL project where all prior Personal Residential Wind-only (PR-W) policies are being rewritten in ePAS. To ensure there is no confusion between the two, please note:
AUW - does not require submission of documents when ePAS auto issued the policy and advises you to retain documents (however, as noted above the documents retained may be requested by Citizens during an audit)
SPL - does require submission of documents

COMPANIES FIND INCORRECT INFORMATION WHEN IT COMES TO WLM
 
Some companies are launching a program to review the application of windstorm loss mitigation discounts. One company reported that during their pilot inspection program of WLM discounts, they found that 83% of the risks inspected had incorrect information regarding WLM features. The top three items found to be incorrect were: Roof to Wall Attachments, Opening Protections and FBC vs. Non-FBC Equivalent Roofs.
 
The companies will send out a letter letting them know that they have been selected for a Windstorm Loss Mitigation Quality Review program.  You are currently receiving various credits on your policy insuring the property, the credits are based upon construction and protective factors determined by the state of Florida that are intended to protect your home from wind damage.  We will be inspecting your home to ensure you are receiving the proper credits as outlined by the state of Florida.  The inspection will be completed on your property free of charge,  by a  representatives that were previously licensed to complete Windstorm Mitigation inspections on behalf of the State of Florida under the My Safe Florida Home program.
The inspection will require access to the interior of your residence in order for inspectors to gain entry to the attic of your home to properly complete the inspection.  A representative of Innovative Inspection Services will be contacting you within the next few weeks in order to make arrangements for the inspection.  We request that either you or an adult representing yourself be present at the time of the inspection.

Check for your unclaimed property before the statewide auction
More than 40,000 items, including jewelry, watches, and rare coins will be auctioned later this month
Florida CFO Alex Sink on Tuesday asked Floridians to check for unclaimed property prior to her Bureau of Unclaimed Property's Statewide Auction, an annual sale of unclaimed safe deposit box contents turned over to the state. The auction, which is open to the public, will be held October 24, 2009, in Ft. Lauderdale at the Embassy Suites Hotel. In the last three months, CFO Sink's Bureau of Unclaimed Property has reunited 67,270 citizens with a total of more than $41 million.
"I encourage all Floridians to visit www.FLTreasureHunt.org and see what property they may have waiting," said CFO Sink. "I am especially proud that in these tough economic times, our Bureau of Unclaimed Property has been able to return record amounts through a diligent, proactive, and business-like approach to seeking owners and responding to citizens."
At the auction, more than 40,000 individual items, including jewelry, watches, and rare coins, with a minimum reserve value in excess of $500,000, will be sold. Featured items include a 13-carat brilliant-cut diamond ring, a Longines diamond and platinum pocket watch, and a Rolex Submariner Oyster Perpetual watch. A free catalog, along with details about the auction, is available at www.FLTreasurehunt.org. Participation in the auction is open to the public, but requires registration and a refundable $100 deposit. A public preview of all items will be held Friday, October 23.
Unclaimed money is deposited into the state school fund, where it is used for public education. There is, however, no statute of limitations, and citizens have the right to claim their property any time at no cost.
During Alex Sink's tenure as CFO, the Bureau of Unclaimed Property has seen record returns, reuniting owners, heirs and businesses with more than one-third of all money returned since the beginning of the program, due largely to aggressive efforts to contact owners. CFO Sink's Bureau of Unclaimed Property returned $173 million in unclaimed property for the 2008-2009 Fiscal Year -- the largest amount in state history. Since the program's inception 48 years ago, the Bureau of Unclaimed Property has successfully reunited owners or relatives of deceased owners with more than $1.4 billion in unclaimed property held in Florida.
The Bureau of Unclaimed Property is currently holding 8.8 million accounts, mostly from dormant accounts in financial institutions, unclaimed utility deposits, insurance benefits, premium refunds, uncashed checks and trust accounts. It also holds watches, jewelry, coins, stamps and historical items from abandoned safe deposit boxes, some of which will be sold in October's auction. Unclaimed property can be claimed for free at any time by the rightful owners or heirs by logging on to  www.FLTreasureHunt.org  or by calling the Bureau at 1-88-VALUABLE.

Citibank, N.A., Hagatna, Guam, has contacted the Federal Deposit Insurance Corporation (FDIC) to report that counterfeit cashier's checks bearing the institution's name are in circulation.
The counterfeit items display the routing number 121405034, which is assigned to Citibank, N.A. The items have ornate top and side borders. A security feature statement is displayed along the top border on either side of the words "CASHIERS CHECK." The words "NAME OF REMITTER" and "ADDRESS" appear in the lower-left corner of the items. A thermochromic icon appears in the top-right corner.
Authentic checks display a security feature statement embedded within a darkened top border. The words "CASHIER'S CHECK" appear vertically along the left side of the checks. The words "LOAN NO." and "REMITTER" appear in the lower-left corner. The bank's logo is top-centered. The bank's location and the statement "Cleared through the U.S. Federal Reserve" are displayed in the top-left corner.

FLORIDA INSURANCE COMMISSIONER ORDERS UNAUTHORIZED COMPANY TO CEASE AND DESIST SELLING HOME SERVICE WARRANTY PRODUCTS
 

 TALLAHASSEE, Fla. - Florida Insurance Commissioner Kevin McCarty today announced that he has issued an Orderto National Home Protection Inc. (National Home) to cease and desist transacting the unauthorized marketing and selling of home service warranty products.
 
Earlier this year, the Office of Insurance Regulation began investigating the company's marketing and claims handling practices, and has determined that it has sold, and continues to sell home service warranty products in Florida without a license. Furthermore, the investigation revealed that many of the claims made for household repairs or service were denied.
 
"This company has been selling these products without a license all across the country," said Commissioner McCarty. "Florida law clearly authorizes me to take action to stop the practices of unlicensed entities to protect consumers in this state."
 
Last April, New York Attorney General Andrew Cuomo announced that his office had received 340 complaints against National Home from consumers in at least thirty-two states. His office filed suit against National Home, a New York City-based company, alleging fraudulent business practices and freezing the company's assets to ensure restitution for defrauded consumers.
 
The Order issued today also requires National Home to honor all policies that are in effect for the duration stated in each contract. The company has 21 days to file a challenge to this action.

Increasing your Revenue Per Client, or How I stay in business and keep all the personnel I need.
 
            As agent's we know a few things.  We know that commissions are going down and service requirements are going up.  We know that we must increase our revenues or we cannot keep the personnel necessary to properly service our clients.  We know that competition is keen and price IS an issue.  We know that many of our clients want to know "How much is it today?" and not "How much is it?"
 
            So, we go to our rating software, enter the information necessary to obtain a quotation and what happens?  We see premiums that are lower annually, but have a higher down payment than premiums that are higher annually, but have a lower down payment.  We choose a company, in come cases, that provide less coverage for more money but have a low down payment. 
 
For many years now,  I have been meeting with agent's who, like any entrepreneur, are just trying to do a good job and make a buck.  That IS the idea of being an entrepreneur.  Do a good job, make a buck.  Keep the family fed and maybe take a vacation once in awhile (ok, probably not too many vacations) (J)
 
            So, as I speak with these nice folks, the theme is pretty much the same.  The pie is the size of the pie.  Each agent gets a piece of that pie.  How can they make more money if the pie doesn't get any bigger.  My answer, find a way to increase your Revenue per Client.  Several companies are doing things to assist the agent toward that end.  Some companies are  incorporating a Towing & Rental Package into their policies.  Some have developed a package that is affordable for the client and has a higher commission for the agent.  Nothing wrong with that, is there?
 
            Some companies continue to utilize Premium Financing as the primary payment source for business.  This allows the agent to present other products to their clients, such as Accident Medical Plans and Deductible Reimbursement Plans, which assist the client in absorbing deductibles on Personal Injury and Comprehensive & Collision claims.  These products are also financeable which make them affordable to the client and help the agent increase the Revenue per Client.  When there are two parties to an agreement and both win, everyone is happy. 
 
When you use a company that allows premium financing of their policies, you have the opportunity sell your client additional products which are beneficial to your clients and assist you in increasing your Revenue Per Client. 
 
In a climate where direct bill carriers  have made down payments so low that it is difficult to compete, even when their premiums are higher than your quoted premium. Agent's often have to choose a higher premium, with less coverage for the client, in order to achieve a lower down payment.
