WHAT IS BUYER/TENANT REPRESENTATION?
By: Bruce Kaplan More and more prospective buyers and tenants are "getting wise" to the fact that they have a right to select a broker to represent them - and only them - in the purchase or lease of commercial real estate. If you simply call the broker on the sign in front of the property, you should know that the broker was hired to represent the interests of the property owner. That being the case, the broker can't represent your interests if he already represents those of the property owner. He can become a "dual agent" (with your permission only), in which case he represents you both with no particular allegiance to either party. For some transactions, this arrangement might be acceptable. If the broker is unbiased, trustworthy and competent, he can exercise care and skill and get both sides an acceptable outcome. But why take a chance on getting less than total allegiance, especially in a transaction of any substance? This article is about when you want an agent to represent you - and only you - as your exclusive representative. I suggest that you consider calling your agent of choice, who will represent your interests in the process of locating, showing, researching, negotiating and closing on a property. My firm does this routinely. We call this type of work buyer or tenant representation or "rep" for short, depending upon whether you are in the market to buy or lease. RETAIL RECOVERY UPDATE *reprinted from the Oakstone/ LAX Morning Minute November 11, 2011 While other property types, like multifamily and office, have shown consistent signs of recovery, retail has yet to do so. Why is retail recovery lagging, and are there specific retail subsectors that are bucking the trend and posting gains? An uneasy standstill It doesn't matter which property types are examined: National numbers imply vacancies moored at levels unseen in at least a decade. Neighborhood and community center vacancy rates have been stuck at 11 percent for the last two quarters, just 10 basis points shy of the 11.1 percent all-time high record last observed in 1990. Regional mall vacancies notched another slight increase in the third quarter, rising to 9.4 percent, the highest level on record since Reis began tracking this property type in 2000. Power centers are doing relatively better, with vacancies at 7 percent as of the third quarter. This is a welcome decline from its cyclical high of 7.6 percent back in the second quarter of 2010. Still, power center vacancies have to decline by more than 200 basis points before it approaches the mid-4 levels at which rates hovered in early 2008, before the downturn gained steam.

WILL INDUSTRIAL REAL ESTATE SPARK A TRUE RECOVERY? *reprinted from the Oakstone/ LAX Morning Minute October 28, 2011 With demand for warehouse space at its highest in years, there's plenty of reason to cheer the state of the U.S. industrial real estate market. There's also plenty of reason to keep a level head, observers say. Recent data show the industrial real estate market in the midst of a sustained rebound from the slump that hit in 2009 and lasted into 2010. The industrial warehouse sector has seen six quarters of positive demand amid strength in autos, mining, electronics and other sectors. "When you string that many positive quarters together it's certainly a sign of strengthening stability," said Kevin Thorpe, chief economist at Cassidy Turley, a commercial real estate services and research firm. Investors have been skittish over the euro zone debt crisis. News of a deal to address it goosed stocks Thursday. Thorpe expects near-term dips in the industrial property market due to continued macroeconomic risks.

Congress May Lower Gift/Estate Tax back to $1 Million This Month!
I read an article this morning by Cleary Gottlieb Steen & Hamilton LLP and know it will affect you or someone you know. In addition to the possible reduction to $1 million, valuation discounts may be eliminated. I have attached relevant paragraphs below. Pass it along where appropriate.
Estate planning techniques for immediate consideration in light of potential tax law changes
The Joint Select Committee on Deficit Reduction (the "Super Committee") is scheduled to announce its proposals on November 23. The proposals may include changes in the current estate, gift and generation-skipping transfer tax laws. In particular, there is concern that the Federal gift tax exemption could be reduced from the current $5 million to $1 million, possibly as soon as December 31 or, while less likely, as early as the November 23 announcement date. Thus, clients may wish to consider making use of their gift tax exemptions in the next few weeks. Several other estate planning techniques may also be of particular interest in the current environment, some of which may be affected by changing tax laws.

STUDY: EXPOSURE TO COMMON AIR FRESHENERS CAN CAUSE ALLERGIES, ASTHMA

Many scented air freshener products contain harmful volatile organic compounds (VOCs) like formaldehyde, petroleum distillates, benzene and limonene, which are known to trigger asthma and other respiratory symptoms, as well as eye irritation, bone damage and leukemia. THINK OUTSIDE OF THE BOX
An old Italian gentleman lived alone in New Jersey . He wanted to plant his annual tomato garden, but it was very difficult work, as the ground was hard. His only son, Vincent, who used to help him, was in prison. The old man wrote a letter to his son and described his predicament:
Dear Vincent, I am feeling pretty sad because it looks like I won't be able to plant my tomato garden this year. I'm just getting too old to be digging up a garden plot. I know if you were here my troubles would be over. I know you would be happy to dig the plot for me, like in the old days. Love, Papa
A few days later he received a letter from his son.
Dear Papa, Don't dig up that garden. That's where the bodies are buried. Love, Vinnie
At 4 a.m. the next morning, FBI agents and local police arrived and dug up the entire area without finding any bodies.
They apologized to the old man and left. That same day the old man received another letter from his son.

November has been a better than average month for executed leases and closed sales. We struggled through a lackluster third quarter when activity was negligible. The federal debt ceiling issue was a true drag on business confidence and that translated into a lot of "fence sitting". Summers are traditionally slow due to vacations. We soldiered through a drought because it's the only way we know how to handle these "valleys". And it paid off! Working on a straight commission can be a real juggling act. We're hopeful that we can catch some sustained momentum. Getting your property sold or leased is our highest priority.

They are selling "billions" of commercial properties each month using their format. Understand most of these properties are selling at liquidation prices.
