In the sandbox.....
As technology continues to advance and our capabilities for collecting and preserving ESI continues to develop, attorneys are faced with challenges when managing the process of e-discovery due to the voluminous amounts of material that could potentially be the subject of discovery. A recent article explores differing perspectives concerning whether adversaries should be encouraged to cooperate when managing ESI. For example, one school of thought is that litigants should work as a team in the management of the e-discovery process so that more time and money can be spent focusing on the substantive issues of the litigation. On the other hand, another school of thought suggests that human nature will not permit one party to play fair in the sandbox if they feel that the opposing party may be hiding a critical piece of evidence.
