Welcome to the May edition of the Custom Legal Solutions newsletter.

In this edition of our newsletter, the Custom Legal team extends our sincerest gratitude to our mothers and to mothers everywhere.  Raising a family is certainly no easy task, and as a certified Women's Business Enterprise, Custom Legal is proof that it is possible to have a successful career and raise a family.  In this edition of our newsletter, we honor those women who have made their dreams of having it all a reality. 

Additionally, our good friend, Tally Weiner has tapped into her research and drafting skills this year to co-author an article in the area of Bankruptcy Law.  We thought that this article would be of interest to our clients, and so Tally was gracious enough to provide us with a summary and citation to her article which we share below.

Custom Legal Salutes Motherhood

Every year, more and more women enter the legal profession.  Is is no secret that the profession is extremely demanding and most attorneys rarely have a 9-5 schedule.  Mothers are usually the first to wake up in the morning, and the last to go to sleep at night.  Even after a full day at the office, many women have little league games, band concerts and homework assignments to tackle.
 
Is it possible for women to have a full career on partnership track, or does the desire to have a family compromise their professional goals?  Luckily there is no single definition of success.  Some women choose to stay on Partnership track, and others may decide that it is not the best course of action for them and choose alternative legal careers.  In honor of Mother's Day, this month Custom Legal salutes all mothers and their personal choices for striking a work-life balance.

Bankruptcy Buzz 

Tally Weiner, a talented attorney, has co-authored an article that explores the statutory fee awarded to Chapter 7 trustees.  According to Ms. Weiner and her co-author, the volume of Chapter 7 filings is up in the down economy.  As a result, Chapter 7 trustees have been called upon to service an increased caseload and are rising to the occasion. The trustees' services are very much needed and yet a meager $60 statutory fee will be awarded to them for time and effort spent on the vast majority of cases in which there are no assets to be administered. 

The article, entitled "On the Nature of the Chapter 7 Bankruptcy Trustee Fee"* argues that commission-based awards in asset cases are a step towards remedying chronic trustee under-compensation and appropriately focuses on benefits obtained for creditors.  Stay tuned as the issue works its way up through the appellate courts, perhaps all the way to the Supreme Court.
