New Management Liability EPL Form
Our new Management Liability EPL form is an enhanced version of our old EP-21000 01/07 policy.  We've made a number of updates to provide you with a much broader new policy.   

 

Highlights include:

  • Claims-made form
  • No built-in warranty statement
  • New definition of insured includes:
    • "Employees" including leased, temporary, part-time, seasonal and volunteers
    • Independent contractors
    • Domestic partners
  • Provides automatic run-off for cessation of subsidiaries
  • Affords automatic threshold for coverage of an acquisition or created entity of up to 25% employee count
  • New definition of employment practice includes:
    • Violation of laws and public policy
    • Possible discrimination including age, race national origin, religion, sex, sexual preference, marital status, disability, medical leave or genetic predisposition
    • Possible employment-related torts including wrongful termination,failure/refusal to hire or promote, wrongful discipline, etc.
  • Offers sever-ability for insured persons and limited imputation of the entity limited to "executive officer"
  • Fraud exclusion utilizes "final adjudication" language
  • New definition of claim includes:
    • Written demand may include monetary/non-monetary demands, tolling agreements
    • Civil, administrative and regulatory proceedings against all insured persons
    • Addresses civil, administrative or regulatory investigations against all insured persons
    • Affirmatively covers arbitrations, mediations and other alternative dispute resolutions.
  • Policy is world-wide where legally permissible
  • Offers 100% allocation for claim expense
  • 90 days post reporting window
  • No requirement of immediate notification for EEOC (or similar actions) claims
  • Only cancellable by insurer for non-payment of premium
  • Provides sever-ability of the application
  • Not auditable

April's Recent Success

Mid South's 4th Annual Conference

This April, the city of New Orleans was abuzz - not just with Final Four, but also with Mid South's 4th Annual Conference...better known as Markel Gras! Over 100 Mid South clients joined us in the crescent city for our annual event.

   

Attendees were treated to their choice of an Air Boat Tour through the swampland, a Cooking Class at the famous Jax Brewery or a relaxing day at Balance Spa. Following the afternoon activities, the evening reception was held at the Piazza d'Italia - a post-modernistic architectural monument to the New Orleans Italian community. Guests were delighted and entertained with magic, caricature art and a bit of 'Sohlid' dance from a local street performer. The weather even held off long enough for us to enjoy a real Cajun crawfish boil. Bugs, anyone?

 

The next day was down to business. Presentations from Ocean Marine PLL, Mike Keely and Environmental PLL, John Termini were first up on the agenda accompanied by Mid South underwriters Jo Sargent and Al Fear. Following was an afternoon of individual meetings, a binding open forum and a small focus group led by Wendy Houser.

 

That evening, cocktails and dinner ensued at one of New Orleans most long-standing restaurants - Arnuad's. Our senses were filled with a Mardi Gras parade museum, live jazz and 'filets you could cut with a butter knife'.

 

The event concluded with a fabulous brunch and awards ceremony. Wendy Houser and Gerry Albanese informed the crowd on the current market and the future of Markel. Jeff Lamb presented our coveted Tony Awards to 5 of our well-deserving agencies. As our guests departed, all were treated to a little New Orleans gospel performance by Shades of Praise!

 

A big thanks to all who attended and we look forward to seeing you at next year's conference!
