Greetings!
The HHS (Health and Human Services) Secretary,
Kathleen Sebelius, on July 30th, 2009 provided the
down payment of 10 million dollars as part of the
payout with the Recovery Act of 2009. One million
dollars is to be used BEFORE Sept 30th on more than
125 ASC surveys in 12 states.
- "We have spoken to a surveyor who had just
turned in a 300-page citation on a Southwest
state ASC."
- "A recent survey in a Central/Midwest State had 4-
surveyors attend the site visit."
- "A deemed status AAAHC center was given 95
page citation in a Rocky Mountain State."
- "One Western State surveyor told us that she was
given the authority to shut an ASC down on the spot if
she so deemed it was necessary."
- "Another surveyor reported that they must follow at
least one patient from admission through to
discharge. Special attention is to be paid to transition
points."
- "Significant findings are occuring in one Northwest
State where physicians and nurses are found to be
complacent."
- "We have been told that surveyors have been
trained to look for cases with less than 90-
minutes"
- "Reports are coming in that surveyors are finding
out when the center opens, are coming
in early on day-one and told that they want to observe
cases on day-one".
- It is in the surveyor's training that the national
management chains having a single Infection Control
Director for all their locations is not sufficient.
Surveyors will be looking for an on-site Infection
Control Director or subcontracted Infection Control
Consultant. If not, the facility will be found non-
compliant.
Another nine million dollars will be made available in
October for the remaining 38 states.
The CDC will make an additional $40,000,000.00
available to state public health departments to
create/expand state-based HAI (Healthcare acquired
infections) prevention and surveillance efforts.

yourself from penalties handed out by CMS.

- Identify the ASC's Infection Control Program:
- 416.51(a) Sanitary Environment, &
- 416.51(b) Infection Control Program
- Obtain the CMS surveyor 'tool' checklist - utilized for
on-site surveys
- Lastly, Lisa has been able to acquire the actual
CMS Infection Training Program used to train the
surveyors. Although we can't give it out, Lisa can
certainly talk through the key point as to what the
inspectors have been told to look for and how to
interpret and rule on their findings.
