| Food Law Means New Responsibilities For Processors | | |
On Jan. 4, 2011,the FDA Food Safety Modernization Act (FSMA) was signed into law. The legislation requires manufacturers and food processors to evaluate and identify food safety hazards in their facilities, implement preventive controls, and document those measures to the FDA. Among some of the new reponsibilites for food manufacturers are:
· Hazard analysis and identification of preventive controls
-- Each registered facility will be required to conduct a hazard analysis of reasonably foreseeable hazards and put into place preventive controls designed to significantly minimize or prevent those hazards.
-- Each registered facility will be required to implement its preventive controls through a system that includes monitoring, corrective actions, and verification that the system is
working properly.
-- Finished product and environmental testing is considered part of the facility's verification process.
· Supply chain management
-- Supplier verification activities are expressly listed as one of the preventive controls to be implemented.
· Records maintenance and access
-- Each registered facility will be required to document its hazard analysis and preventive controls system, including corrective actions and product/environmental testing, and to make those records available to FDA upon request.
· Intentionally introduced hazards
-- Each registered facility will also be required to conduct a hazards analysis of those hazards that may be intentionally introduced, including those introduced by acts of terrorism, and to implement appropriate mitigation steps as deemed necessary by the FDA.
· Traceability
-- FDA will be required to conduct pilot tests and issue regulations for "high risk" products; the bill contains many restrictions on FDA's authority, including no "full pedigree"
requirements and an express exemption for "commingled raw agricultural commodities."
· Fresh product standards
-- FDA will be required to issue mandatory standards for "high risk" types of fresh fruits and vegetables and update its good agricultural practices covering the remaining product categories.
To prepare for compliance, manufacturers and food processors should begin to look at their processes, determine what safeguards are already in place, and what needs to be implemented to ensure better food safety.

| IL Passes Historic Tax Increase | |
Last week IL lawmakers passed the largest tax increase in state history in a effort to close the state's $15 billion budget deficit. They raised the personal income tax by 67% and business taxes by 46%. The bill passed without a single Republican vote.
The measure took effect immediately after Gov. Quinn signed it into law, increasing the annual income tax from 3% to 5 %. The enactment calls for an increase lasting until 2015 when it would drop to 3.75%. Income tax rates would remain at that level until 2025 when they would decrease to 3.25%. The agreed upon raise was less than the 75 percent increase Democrats had hoped for. They argued the tax increase was needed to rehabilitate the state's deadbeat image, but Republicans predicted it would drive businesses out of state.
The current 4.8% corporate rate would go to 7% until 2015, when it would drop to 5.25%. The rate would then fall in 2025 to the current 4.8%.

| WI Special Session Tackles Taxes, Regulatory Reforms | |
WI Governor Scott Walker called the WI Legislature into special session on January 4 to consider legislation on a variety of topics, including tax credits (SSSB 3, 4, 7), tort law, medical savings accounts, and other legislation relating to taxation.
He has also introduced a bill to reform Wisconsin's regulatory process. The measure contains a number of provisions including:
- Agencies may not create rules more restrictive than the regulatory standards or thresholds provided by the Legislature;
- Agencies cannot create rules based on the agency's general powers or duties;
- Rules can be challenged in the county circuit court where the plaintiff resides;
- The Governor must approve proposed rules;
- Require an economic cost/benefit analysis of rules changing wind energy citing standards;
- Targeted wetland regulatory reform.
The State Assembly is poised to take up companion bills on medical savings account contributions, tax credits for businesses relocating to the state and increases in the amount of credits under the economic development tax credit program on Thursday of this week.
MWFPA supports the regulatory reforms as a means of combating regulatory creep. It has also called for support of the proposed tort reforms.

| Environmental Permitting, Jobs On MN Agenda | |
The first bills introduced in the MN Senate and House for the 2011 session address job creation and the environmental permitting process.
The bill, HF 1 and SF 1 are designed to encourage businesses to build and expand in Minnesota by lowering corporate tax rates and speeding up the environmental permitting and review processes. Legislative hearings on this initiative could begin as early as this week.

| Safety Conference Set In Wisconsin Dells - Feb. 16 & 17 | |
The Food Processor Safety Conference, cosponsored by Midwest Food Processors Association and the Wisconsin Safety Council, is set to take place on February 16 & 17, 2011 at the Kalahari Resort in Wisconsin Dells, WI. MWFPA and WSC members will receive a 10% discount for multiple attendees.
The keynote session will feature Mr. Bob Emmerich, President of Safe Con LLC speaking on identifying and preventing hazards in the food processing industry. Mr. Emmerich will cover many of the basic safety issues in the food processing industry that create the primary hazards and will demonstrate some of the more common safety issues in the industry including ways to protect you and your employees from those hazards.
A Professional Development Course (PDC) covering incident investigation is on the second day of the conference -- February 17. Participants will receive Supervisor Safety Certification and Advanced Safety Certification.
