 Testing for Lead:

Two Schools of Thought

 

 The decision to test for lead is purely subjective. There are two schools of thought, one supporting testing and one rejecting it. To comply with RRP, the choices are: to assume that lead is present, to hire an environmental professional to perform the test, or to test using an EPA approved test kit.

 

Assume there is lead present

To assume lead means that every job in a target property will be set up as a lead job. This may simplify your job set ups by having only one set of standards. This will also mean that bidding jobs will be more straightforward. However the required consumables and equipment will add cost to your jobs. Areas such as the North East have very old housing stock. In these areas, the chances of having a negative test are fairly slim, so it would make sense to minimize the cost and time by assuming that lead is present.

 

Choose to test

If you choose to test, you may either perform the test yourself or have a professional environmental firm perform the testing. Choosing to hire an outside firm for a surface-by-surface test using an XRF machine will provide non-destructive testing with more comprehensive results. An X-Ray Fluorescence Machine uses x-rays to look at the chemical makeup of an object or material and thus can tell if lead is present. As a Certified Renovator, you only have to test one of each component. For example, on a window that is all painted the same, you only have to test any one component from the sash, header, trim, or apron. A surface by surface inspection would test each of these components separately.

 

Some firms are now offering RRP specific testing (testing only a limited area for a reduced price or even by the hour) while others only provide the HUD style whole property lead inspection. If you develop a good relationship with a local environmental firm, you may be able to get better pricing and even have room to markup the service a bit. This type of service can cost anywhere from $200-$1000 for a whole property inspection depending on the size of the job.

 

One of the largest benefits of using an outside service is that it relieves you of any liability. Environmental firms carry specific insurance to protect them, and the risk would be deferred to the environmental firm if any problems arise later. This inspection report becomes permanently attached to the property, so it establishes a blueprint of lead contamination for any ongoing and future remodeling activities.

These reports will also provide the home owner with a report showing that the home is clear of and lead contamination. With a professional lead inspection, your firm can use untrained workers and subcontractors to perform work in "clear" areas of the property without concern about liability.

 

Testing the area yourself is less expensive and faster. If you are only working in a small area, at around $3 per test, this can be a much better alternative to hiring a professional. However, you will have to stock test kits and only a Certified Renovator can perform the test. This may mean that you will have to have some of your personnel trained as Certified Renovators, and it may complicate the bidding process if you choose not to test before contracting to do the job. Additionally you are required to provide the results of the test to the homeowner, who could then present those results to another firm who may end up winning the contract.

 

Risk is a major factor in this decision as well. If you perform the testing yourself, you only have to choose one component to test. If it is later discovered that lead was present, either in a different component or because the test kit/sampling process was faulty or if there is an elevated blood lead level case at the property, all of the liability is on you. There are no protections against this, in part because of the self certification process.

 

If you choose to test the area to be affected, you may use one of two commercially available test kits (LeadCheck or D-Lead). Ring's End has test kits available for purchase in our paint departments. Each of these have benefits and drawbacks. In short, LeadCheck is easier to use, results are instantaneous, and has an indefinite shelf life. However, they cannot be used on drywall, stucco, plaster, or other gypsum based surfaces, nor can they be used on red surfaces. D-Lead is more complicated to use and takes longer to read, but is approved for use on all surfaces, including drywall, ferrous metals, wood, and nearly anything else you can think of. It carries a 12 month expiration date, and the manufacturer has been very good about refurbishing expired kits. Just call them and they will send you replacement chemicals, a new lot number, and a new expiration date.

 

Please Note:

There has been some confusion about re-using the LeadCheck kits. Some trainers and others have claimed that you can test up to 3 surfaces with one test kit. This is not correct! This is in violation of the manufacturer's instructions, and the EPA approves these test kits on the contingency that you follow the manufacturer's directions!

Fall Protection in Residential Construction

The United States Department of Labor's Occupational Safety and Health Administration (OSHA) has announced the withdrawal of the Interim Fall Protection Compliance Guidelines for Residential Construction (STD 03-00-001). Prior to this announcement, STD 03-00-001 allowed contractors to engage in certain residential construction activities by using specified alternative methods of fall protection (e.g., slide guards or safety monitor systems) rather than the conventional fall protection (guardrails, safety nets, or personal fall arrest systems) required by the residential construction fall protection standard. This meant that you could use these alternative measures without first proving that the use of conventional fall protection was infeasible or created a greater hazard and without a written fall protection plan.

With the issuance of the new directive, all residential construction employers must comply with the duty to have fall protection regulation.

  • Residential construction employers generally must ensure that employees working six feet or more above lower levels use guardrails, safety nets, or personal fall arrest systems. A personal fall arrest system may consist of a full body harness, a deceleration device, a lanyard, and an anchor point. (See the definition of "personal fall arrest system" here).

    • Other fall protection measures may be used to the extent allowed under other provisions of OSHA regulation .501(b) addressing specific types of work. For example, OSHA permits the use of warning lines and safety monitoring systems during the performance of roofing work on low-sloped roofs. 
    • OSHA allows the use of an effective fall restraint system in place of a personal fall arrest system. To be effective, a fall restraint system must be rigged to prevent a worker from reaching a fall hazard and falling over the edge. A fall restraint system may consist of a full body harness or body belt that is connected to an anchor point at the center of a roof by a lanyard of a length that will not allow a worker to physically reach the edge of the roof.
  • If the employer can demonstrate that use of conventional fall protection methods is infeasible or creates a greater hazard, it must ensure that a qualified person:

    • Creates a written, site-specific fall protection plan in compliance with OSHA 1926.502(k); and 

    • Documents, in that plan, the reasons why conventional fall protection systems are infeasible or why their use would create a greater hazard.

The new directive interprets "residential construction" as construction work that satisfies both of the following elements:

  • The end-use of the structure being built must be as a home, i.e., a dwelling. 

  • The structure being built must be constructed using traditional wood frame construction materials and methods. The limited use of structural steel in a predominantly wood-framed home, such as a steel I-beam to help support wood framing, does not disqualify a structure from being considered residential construction.
