As the year comes to a close, it's time to reflect on the business goals you set for 2011. Did your business accomplish what you set out to do? Why or why not? Make some notes about your successes and any goals you fell short on. Organizations that analyze their 2011 business in order to plan for 2012 will have the best opportunity to reach new goals.
Next year will substantially alter the 401(k) industry as fee disclosure regulations come into effect. 408(b)(2) regs will require service providers to provide plan sponsors with full fee disclosure statements. Additionally, plan sponsors and fiduciaries must give plan participants full disclosure of the individual costs of the plans' administration and a comparative chart of investments.
These changes present financial advisors with a great opportunity for showcasing their value and offering additional value-added services to their clients. This is especially true of employee education programs, which fiduciaries and plan sponsors can use to reduce their liability. Please read the article below to learn how you can help your clients prepare for participant disclosure regulations.

Fee Disclosure Regs Present Opportunities for Advisors
Wal-mart and Merrill Lynch have settled to the tune of $13.5 million for excessive plan fees. This long-running class action suit launched from one participant complaint. As a financial advisor, you are probably well-aware of the DoL's April 1st deadline for 408(b)(2); full fee disclosure to plan sponsors. The hype over this regulation has somewhat overshadowed the new participant disclosures under 404(a)(5) of ERISA. This regulation requires plan sponsors and fiduciaries to disclose plan fees to every participants, as well provide a comparative chart of the plan's investments.
After dealing with fee disclosures from all service providers by April 2012, plan administrators must create and distribute individual cost analyses to each plan participant starting May 31, 2012. These documents, unlike the SEC's "plain English" standard, must be written "in a manner calculated to be understood by the average plan participant."
This will undoubtedly cause anxiety among plan administrators. They will be turning to their service providers for support. As a valued advisor, now, would be a good idea to start working with your clients on an action plan.
Financial advisors should also use this opportunity to work with plan sponsors and fiduciaries to institute employee education programs. Recommending education for plan participants will highlight your value as an advisor and differentiate you from other advisors.
The education programs should be documented in an Education Policy Statement (EPS). An EPS describes the objectives of the education program, the frequency of the informational meetings that will be held for participants, the educational topics to be covered and any other relevant information.
The Elements of an EPS
An EPS has five major components:
1. Purpose and Background
2. Plan Objectives
3. Roles and Responsibilities
4. Performance Standards
5. Results
The EPS should also include a list of investment materials that is provided to participants, as well as a list of topics discussed at participant education meetings.
The standards of disclosure created by the DoL encourage a broad range of education for participants, which not only provides a variety of benefits for plan sponsors and participants, but also allows advisors to demonstate how they will add value by helping their clients develop Education Policy Statements.
Remember, participant disclosure deadlines begin May 31, 2012. Now is the time to discuss these issues with clients. Financial advisors should ask their clients if they have an EPS. If no EPS exists, this is a great opportunity to explain how it can help the client reduce their risk as a fiduciary, retain employees as well as ease concerns from plan participants.

Build Leads though LinkedIn
It's important for financial advisors to build leads, which boost business development. LinkedIn is an excellent tool for financial advisors to identify prospective clients and referral sources. By using the "advanced search" option, you can easily filter and narrow prospects in your targeted industry. The "advanced people search" has options to highlight keywords, names, locations and postal codes, as well as job titles, schools and companies. If individuals or businesses use certain keywords numerous times throughout their profile, those names should come up first on the search page.
For example, if CPAs are good referral sources for you, you can search for CPAs in your zip code and build your database of accountants. With LinkedIn's Business, Business Plus or Executive paid accounts, you can search by company size, interests, years of experience and Fortune 1,000. Seniority level and function are in beta testing.
While you can build a robust pipeline with FreeErisa and subscription databases, such as Judy Diamond and Larkspur, don't neglect LinkedIn's platform with increasingly better search capabilities, which can provide an important tool in the everlasting pursuit of leads.
