Yesterday, the USCIS updated its published count of FY2012 cap-subject H-1B petitions and advanced degree cap-exempt petitions receipted.

As of 8/12/11, approximately 25,300 H-1B cap-subject petitions were receipted against the annual quota of 65,000.

USCIS has receipted 14,700 H-1B petitions for aliens with advanced degrees against the additional quota of 20,000.
FDNS (Fraud Detection Unit) Questionnaire

The Fraud Detection and National Security (FDNS) unit of the U.S. Department of Homeland Security recently sent an H-1B employer a written questionnaire to complete with respect to verification of the information provided in the employer's H-1B petition.

The FDNS typically conducts on-site investigations to verify claims made in H-1B petitions, such as the job title and duties of the H-1B beneficiary, the work location, and income, among others.  In some cases, where the employer's HR representative or the H-1B beneficiary is unavailable, the FDNS officer may follow-up by phone.

The written questionnaire, issued by FDNS at the Vermont Service Center, may become a more common method for conducting FDNS investigations.

The questionnaire received by the H-1B employer may be viewed in the Compliance section of the Helpful Links page of my web site.
