Judge Extends Deadline to Join PTSD Class Action Lawsuit

 

More Time For Eligible Veterans to Join PTSD Lawsuit
 
Traumatic brain injury (TBI) and post-traumatic stress disorder (PTSD) have proven to be two signature injuries of the wars in Iraq and Afghanistan.  Thousands of service members have been discharged from military service as unfit due to the impact of PTSD. Unfortunately, a significant percentage of these veterans did not receive the military disability benefits they were due under the law because the military ignored a controlling regulation. Now these former service members have additional time to join a class action lawsuit to correct the problem, thanks to a critical deadline extension.

Help NVLSP reach out to OEF/OIF veterans discharged because of PTSD
 
National Veterans Legal Services Program (NVLSP) has been involved in an ongoing class action lawsuit for veterans of Operation Enduring Freedom and Operation Iraqi Freedom.  4,400 veterans discharged from military service as unfit because of PTSD are eligible to join the lawsuit.  Unfortunately, only about 1,800 eligible veterans have completed the "Opt-in Forms." The November 10, 2010 deadline is quickly approaching.  If you know an Operation Iraqi Freedom or Operation Enduring Freedom veteran discharged because of PTSD, he or she may be eligible to join the lawsuit. 
 

Agent Orange Update 

Vietnam Veterans win as the Veterans Administration Recognizes Three New Diseases Associated to Agent Orange Exposure
 
National Veterans Legal Services Program (NVLSP) and other veterans service organizations scored a victory for Vietnam veterans suffering from diseases associated with Agent Orange exposure. On August 31, 2010, based on the lawsuit filed by NVLSP and other veterans organizations, the United States Court of Appeals for the Federal Circuit ordered the Department of Veterans Affairs (VA) to publish a final regulation which added ischemic heart disease, Parkinson's disease and chronic B-cell leukemias to the list of diseases that are linked to exposure to Agent Orange.
 

NVLSP Helps Older Veterans

NVLSP and Chadbourne & Parke LLP Win Case For Older Veterans
 
National Veterans Legal Services Program (NVLSP) joined with attorney Thomas Riley of Chadbourne and Parke LLP to assist Korean War veteran, Howard Chandler.  Mr. Chandler's application for a special pension designed for low-income, totally disabled, elderly, wartime veterans was denied by the Board of Veterans' Appeals because he had become totally disabled and received a pension before turning 65. NVLSP and Mr. Riley appealed the case to the United States Court of Appeals for Veterans Claims.  There they successfully argued that Mr. Chandler should not be denied this special, additional pension simply because of the age at which he became totally disabled.  Mr. Chandler's victory could help other elderly veterans who find themselves in similar situations.

National Veterans Legal Services Program (NVLSP) is pleased to announce our second annual benefit reception: "Honoring Service and Sacrifice." The event will take place on Tuesday, November 9, 2010, from 6:00 p.m. - 8:00 p.m. at the Women In Military Service for America Memorial in Arlington, Virginia. Bob Woodruff of ABC News will be our Master of Ceremonies. Awards to be presented that evening include the second annual Senator Daniel Inouye Award which will be given to Sesame Workshop for their series Talk, Listen, Connect; the Pro Bono Partner of the year award which will be given to Morgan Lewis and Bockius; and the Outstanding Public Service award which will be given to The American Legion. Regrettably, our original keynote speaker, Admiral Michael G. Mullen, informed us that he will be unable to attend due to an unexpected change in his schedule. After we confirm our new keynote speaker, we will update you with that news.
