| ECA Membership Meeting
The Electrical Contractors' Association of City of Chicago (ECA) held its November Membership Meeting on Thursday, November 3, 2011 at the Doubletree Hotel in Oak Brook, Illinois. The meeting featured a brief presentation from Mr. William Divane, EIT Chairman, Divane Bros. Electric Company. Mr. Divane gave a brief update as to the status of the industry health and welfare and benefits funds. He highlighted statistical data, as well as the following in his report: the overall benefits funds are in good shape - the funds are at least 85% to 90% funded; Plan 5 Defined Contribution Fund is worth over $1,000,000,000; there is no unfunded liability with Pension Plan 2; Health and Welfare funds continue to be strong. He also discussed "owner-in-fact" concerns, initiation of a stringent fraud policy and unfunded liability for retiree healthcare. We, again, thank Bill for his continued service to the industry.

CISCO Legislative Committee
The Electrical Contractors' Association of City of Chicago (ECA) is an active member of the Construction Industry Service Corporation (CISCO). CISCO is a labor-management organization that represents all facets of union construction in the northeastern Illinois area. The CISCO Legislative Committee meets to discuss mutual legislative issues of concern that affect union representation, as well as union contractors on a local, state and national level. The CISCO Legislative Committee meeting held on November 7, 2011 featured two guest speakers: Mr. Timothy Leahy, American Water Executive Director and Mr. Mark Frost, JULIE Executive Director. Each discussed potential legislation in the Illinois General Assembly affecting their constituent groups. The Committee further discussed issues regarding the Veto Session in Springfield and will meet soon to coordinate mutual concerns for the 2012 legislative cycle. ECA Research and Education Update
The ECA Research and Education Committee is active year round. Educational programming for the coming year is being defined. However, several seminars are already in place, including the following: February 2012: "Building High Performance Teams" March 2012: "Communicating Effectively with Challenging and Difficult Personalities" April 2012: "Comprehensive Practices for Effective Project Management" May 2012: "Financial Principles and Tools" The ECA Research and Education Committee will be considering future programming that will include the following: additional MEI courses, Electrical Estimating Workshop, EPS Fast Track Series, Pre-Membership Meeting programs, ECA Spring Conference Business session, as well as specialty programs that come up on an as needed basis during the year. Registration information for these seminars will be forthcoming.

ECA IIT IPRO Update
The ECA Student Committee met in mid-November to review the progress of the ECA Illinois Institute of Technology Interprofessional Program (IIT IPRO) for the Fall 2011 session. The IPRO is called, "Developing Cost-Effective Electrical Smart Grid Technologies for Residential and Commercial Applications." The ECA is working with a group called, Operation Green Jobs in coordinating the IPRO. The IPRO is focused on addressing the problem of how electrical contractors can employ electrical Smart Grid technologies that are cost effective and offer a realistic Return on Investment with "green" benefits for residential and commercial customers. As of this writing, the students are to compete in a school-wide IPRO Competition. We wish the students the best of luck. Also, the Winter/Spring 2012 IPRO will focus on the 2012 NECA Green Energy Challenge. The challenge will focus on the completion of an energy audit for an actual facility on the campus of IIT. If the IIT team advances, the finalists will compete during the 2012 NECA Convention. 3% Withholding Tax Update
The U.S. House of Representatives and the U.S. Senate successfully passed, in near unanimous fashion, legislation that would repeal requiring governmental entities to withhold 3 percent of contractor payments as a prepayment of taxes. This victory represents over six years of constant advocacy on behalf of NECA and other construction groups.
The 3% repeal legislation was introduced with record-breaking bipartisan support. The co-sponsors of H.R. 674 are Reps. Wally Herger (R-CA) and Earl Blumenauer (D-OR), both strong NECA allies. The legislation garnered over 260 bipartisan co-sponsors as it moved through the House Ways and Means Committee. In the Senate, companion legislation S. 89 was introduced by Sen. David Vitter (R-LA) and S.164 was introduced by Sen. Scott Brown (R-MA). The Senate passed the repeal legislation in early November.
President Obama indicated his support for the repeal of 3% withholding and has referred to these ill-conceived rules that are set to take effect on January 1, 2013, as "burdensome withholding requirements that keep capital out of the hands of job creators." NECA was correct as it believed the President would follow by signing the bill into law. President Barack Obama signed into law on November 22, 2011 the "VOW to Hire Heroes Act," or H.R. 674, legislation to repeal of the imposition of 3 percent withholding on payments made to vendors by government entities, while also extending incentives for employers hiring veterans. The President signing H.R. 674 ends a 6-year effort to repeal this withholding tax that would have been detrimental to NECA contractors. NECA's Executive Director of Government Affairs, Lake Coulson and NECA's Director of Legislative Affairs, Kristen McDonough have been working together with our contractors to assist in the repeal efforts. Thank you to NECA members for their efforts in support of legislation that would repeal the tax. Contacting Congressional members, advocating for repeal, and participation at NECA legislative conferences have greatly influenced the bill's passing and signing into law.

NECA Midwest Regional Conference
The NECA Midwest Regional District 4 & 7 Conference will be held March 18 - 21, 2012 at the Loews Ventana Canyon Resort, Tucson, Arizona. NECAWORKS™
The NECAWORKS program, a web-based total energy solutions screening tool for the exclusive use of NECA members was recently introduced.
NECA contractors are adapting their businesses to provide total energy solutions for their clients. There exists great value in working with existing and new clients to provide a variety of energy-related services, including energy audits, implementation of energy efficiency measures and installation of renewable energy solutions. These services ultimately involve a reduction in clients' energy costs with a more environmentally friendly solution. Typically, a client is asked to invest up-front capital in exchange for a reduction in energy costs over time. The client expects to see a return-on-investment of the project, taking into consideration the value of money spent in the present and future. Therefore, a project pro forma, or financial projection, based upon the costs and energy usage over the life of the project must be generated.
The NECAWORKS™ website offers the fundamental tools and information links to "screen" a project. Using data supplied by you and your client, it determines a "Benefit/Cost Ratio", or "B/C Ratio" for projects you intend to bid. What is a Benefit/Cost Ratio? It is a calculation - based upon your input of the project's costs, energy and other applicable factors - that serves as an indicator of the project's worthiness of "next step" decision-making and should be used to rule out projects that have a low probability for success and highlight projects that may pass your client's return-on-investment objectives.
