| ECA October Membership Meeting
The Electrical Contractors' Association of City of Chicago (ECA) held its October Regular Membership Meeting on Wednesday, October 7, 2009 at Gibsons Steakhouse Restaurant in Rosemont, Illinois. The guest speakers for the luncheon were Mr. Daniel Allen, Chief Electrical Inspector of the City of Chicago and Dr. John Donahue, Director IBEW-NECA Technical Institute (INTECH).
Dr. John Donahue gave a detailed update of the educational programming available at INTECH.
Chief Electrical Inspector Allen discussed many topics involved with the Electrical Bureau, contractors working in the City and the overall electrical industry in Chicago. Highlights of his presentation include the following: The City of Chicago has just begun a revision of the Building Code; however, the Electrical Code is not being reviewed at this time. It is anticipated that the overall review process will take a year to complete. The Electrical Inspection Bureau is committed to ensuring that electrical projects in Chicago have the proper permitting by enforcing permit and code criteria.
He also discussed trade licensing issues, on-line permitting issues, sign permitting, among other permit acquisition issues. He emphasized that the Department of Buildings remains vigilant in enforcing the code in regard to code violations. He encouraged feedback from the contractors regarding the Electrical Bureau, as well as feedback concerning overall Building Department activities. We thank Chief Electrical Inspector Allen and Dr. John Donahue for sharing their time and insight.

| Member Receives EA "Hall of Fame" Award
Michael Walsdorf, Advent Systems, Inc. was inducted into the Electric Association's (EA's) Hall of Fame during the EA's Member Award's Celebration which was held on October 15th at the Carlisle Distinctive Banquets in Lombard, Illinois.
Mike exemplified the "Hall of Fame" criteria of honoring outstanding individuals who have played a key role in the development and nurturing of the electrical industry and who have played a creative role in Chicagoland. The award recognizes individuals whose innovation, hard work, dedication and vision have fostered industrial growth and social progress. Congratulations, Mike!

| ACE Tech Awards Gala
On October 15, 2009, the Architecture, Construction and Engineering Technical Charter High School (ACE Tech) held its fifth annual fundraiser gala. The event was held at the Hyatt Regency Crystal Ballroom in Chicago, Illinois. ACE Tech honored its students, faculty, volunteer parents and friends from the industry for their continued service to ACE Tech.
Eric Nixon, Maron Electric Company, accepted an award in memory of his late father, Jerry Nixon who was presented with the "John Donahue Award" for his unwavering effort to promote the benefits of ACE Tech for the community. Jerry was a guiding force in his role as President of the Labor Management Cooperation Committee of Chicago (LMCC/Chicago) in the early days of ACE Tech.
As in prior years, the theme for the evening was the emphasis placed on ACE Tech's Mission Statement which is as follows: "To provide for our students the highest level of instruction and academic achievement combined with exemplary character development that will prepare them for post-secondary and apprenticeship education and sustained lifelong success."
ACE Tech needs the support of the entire Chicagoland Construction Industry to continue its mission. Funding comes from many sources and ACE Tech must continue the funding mechanisms that are in place to ensure that ACE Tech will prosper in the future.

| The ECA IIT Fall 2009 IPRO
The Electrical Contractors' Association of City of Chicago's (ECA's) Illinois Institute of Technology Fall 2009 Interprofessional Program (IIT IPRO) is focusing on ways electrical contractors can better run their projects. The students are investigating the use of Project Management tools such as Building Information Modeling (BIM) technology. The students were able to participate with a unique jobsite tour. The ECA Student Committee wishes to thank McWilliams Electric Company, Inc. and Bulley & Andrews, LLC for the tour of Stage 1 of a "Clean Lab" - Wexford project at 3440 S. Dearborn in Chicago, Illinois. Mr. Scott Swayze, Project Manager, McWilliams Electric Company, Inc. and Mr. Duane Czerwonka , Superintendent, Bulley & Andrews, LLC gave the tour on October 8, 2009.
Highlights of the tour include the following: the project is to be completed in four stages; each stage has stringent protocols to follow; the protocols regarding potential contaminants increase as each level progresses. Swayze and Czerwonka briefly discussed the layout of the complex project and emphasized that coordination among all the trades is crucial for the project to be completed properly; quality assurance is another important aspect to the job for each stage/procedure to be validated. The students viewed the electrical room, the mechanical rooms/spaces, learned about the fire alarm coordination, the importance of the workers understanding about the locations/operations of the magnetic locking devices, the color-coding of the conduit runs, the air filtration system. The students were able to see a project in its beginning stages and have a better grasp of the many responsibilities Project Managers have on the job. The students are to complete this IPRO in early December 2009.

| NECA MEI -- "Conflict Prevention and Resolution"
We are pleased to inform you that the NECA Management Education Institute seminar entitled "Conflict Prevention and Resolution: From Expedited Job-Site Issue Resolution to Enhanced Claims Negotiations" will be held 8:00 am - 5:00 pm, Thursday, November 19, 2009 at the Wyndham O'Hare Hotel, 6810 N. Mannheim Road, Rosemont, IL (847/297-1234). Mr. Bob Randolph, a partner in the management consulting firm of Carr, Swanson and Randolph will lead this very informative full day program. Mr. Randolph is a certified mediator and has served as a facilitator on Partnership and ADR workshops. This seminar will address the life cycle of conflict, ways to avoid dispute on construction projects, dealing with structural conflicts in and between organizations. Participants will learn methods to understand, identify, and resolve conflicts and disputes specifically related to the construction industry. The Registration Fee is $385.00 per person. However, we are pleased to inform you that Electrical Contractors' Association members who attend the MEI program "Conflict Resolution" will be reimbursed $193.00. This represents a 50% savings over the price charged to other participants! This offer is valid for up to three (3) people per Company.

Illinois Prevailing Wage Act Update
Three separate prevailing wage bills aimed at clarifying what work is covered and how contractors are to be notified that projects are subject to prevailing wage requirements were passed by the General Assembly and signed into law by Governor Pat Quinn this summer. These changes become effective January 1, 2010.
Senate Bill 223 (Public Act 96-0058) clarifies that "public works" includes all projects funded in whole or in part through bonds, grants, loans or other funds made available by or through the State or any of its political subdivisions.
House Bill 952 (Public Act 96-0186) amends the law to explicitly cover all demolition work undertaken by a public body, regardless of whether or not the demolition work is in conjunction with a public works construction project.
House Bill 163 (Public Act 96-0437), holds public bodies financially responsible for any interest, penalties or fines assessed by the Department if they fail to provide proper written notification to a contractor that a project is subject to the Prevailing Wage Act. Similarly, contractors that fail to notify their subcontractors that a project is subject to prevailing wage requirements will be held responsible for any interest, penalties or fines assessed by the Department. However, regardless of whether or not they were properly notified, contractors that fail to pay the proper wages to their workers are still responsible for all back wages owed to those workers. 2011 Edition of NFPA-70E being developed
The review cycle for NFPA 70E, Standard for Electrical Safety in the Workplace has begun. Once again, John Luke of ESCO Electric in Marion, Iowa, is representing NECA on the NFPA 70E Committee. NECA Safety Director Jerry E. Rivera will serve as his alternate. If you are interested in recommending a change to this standard which has become increasingly important to our industry, e-mail jerry.rivera@necanet.org. The deadline for submitting proposals is January 5, 2010.

| NECA IIT Student Chapter
As you are aware, the Electrical Contractors' Association of City of Chicago (ECA) works with the Illinois Institute of Technology (IIT) on various projects. In the late Spring of this year, a Student Chapter was formed. At the October NECA IIT Student Chapter Meeting held on Thursday, October 22, 2009 at IIT, a representative from the ECA assisted with a presentation regarding "Project Management." The attendees appreciated the time and effort put into the special presentation made by Jack Smith, Project Manager, Gibson Electric & Technology Solutions.
Highlights of the presentation include the following: Defining the role of the Project Manager, Pre-construction phase components, preparing proposal, bid submittal, scope of project, responsibilities from award of project to conclusion, contract review, cost control, finance issues, customer relations, safety, coordination of all aspects of a job, among other areas.
Other sessions are to include guest presenters speaking on topics relevant to the construction industry. It is anticipated that other topics of discussion are to include the following: Safety, Estimating, Code issues, Networking/Salesmanship, Quality Assurance and the process of Business Development/Marketing, especially during a recession.

| OSHA Record Keeping Initiative
The U.S. Department of Labor's Occupational Safety and Health Administration (OSHA) is initiating a national emphasis program (NEP) on recordkeeping to assess the accuracy of injury and illness data recorded by employers. The recordkeeping NEP involves inspecting occupational injury and illness records prepared by businesses and appropriately enforcing regulatory requirements when employers are found to be underrecording injuries and illnesses. "Accurate and honest recordkeeping is vitally important to workers' health and safety," said acting Assistant Secretary of Labor for OSHA Jordan Barab. "This information is not only used by OSHA to determine which workplaces to inspect, but it is an important tool employers and workers can use to identify health and safety problems in their workplaces." The inspections include a records review, employee interviews, and a limited safety and health inspection of the workplace. The NEP will focus on selected industries with high injury and illness rates. At the request of the Senate Committee on Health, Education, Labor and Pensions and the House Committee on Education and Labor, the Government Accountability Office (GAO) issued a study on the accuracy of employer injury and illness records. This NEP will help OSHA work cooperatively with the GAO. It also complements the Labor Department's Bureau of Labor Statistics' (BLS) efforts to investigate factors accounting for differences between the number of workplace injuries and illnesses estimated by BLS and those estimated by other data sources. Under the Occupational Safety and Health Act of 1970, OSHA's role is to promote safe and healthful working conditions for America's men and women by setting and enforcing standards, and providing training, outreach and education.
