Payroll Tax Reduction Extended

Congress has extended the payroll tax reduction until February 29th, 2012 under the Temporary Payroll Tax Cut Continuation Act of 2011.  Under the bill, the employee's portion of FICA taxes is reduced from 6.2% to 4.2% for wages paid from January 1, 2012 through February 29, 2012 up to $18,350.  Any wages paid in excess of $18,350 during the first two months that did apply the 6.2% FICA tax will be subject to recapture rules.  There will continue to be negotiations in congress that may extend this benefit through the end of the year.  For those companies that may be in a position to front-load certain wages paid, it may be a good idea to accelerate wages to fit as much under the $18,350 cap as possible in case the legislation is not extended past February 29th.

Failure to Timely File Correct Information Returns Can Lead to Large Penalties

The term information return means any statement, form, or return required to be filed with the IRS to advise it of an amount (e.g., taxable income) paid to another person. While many types of forms and statements come within this definition, for payroll purposes, the Section 6721 penalty can apply to (1) Form W-2 (Wage and Tax Statement); (2) Form 1099-MISC (Miscellaneous Income), as well as other forms in the 1099 series; and (3) Form 8027 (Employer's Annual Information Return of Tip Income and Allocated Tips).
