Celebrating Women's History Month    

Last month I was blessed to join four other powerful, vibrant and independent women in Paris France.  We gathered for a week of rest and reflection in a spacious three bedroom apartment on the banks of the River Seine with a stunning view of Notre Dame Cathedral at the generous invitation of my sister Simona.  Although we came from five different cities across the U.S., we quickly confirmed that we share a common vision and understanding of our roles and responsibilities as African-American women.  We shared an appreciation of our blessings and our uniqueness as the descendants of slaves who have survived in the land of the oppressor!!  We are not just living the dream - we are the dream!!!

One of the lessons shared is not to run from the past.  We must embrace and celebrate our history, the progress made before us and through us, and certainly, the strength it took to make that progress.

Thank God for strong women.  Carry on with your bold self!!!

Nurturing Women Lawyers

As we celebrate Women's History Month, we would like to acknowledge women in the legal profession and the work they do both professionally and in the community.  We acknowledge the strides that women have made and continue to make, in achievements almost unthinkable in the too recent past.  The following organizations help to lay that foundation of opportunity and provide support along the path.

BWLNC

Black Women Lawyers Association of Northern California
 

The Black Women Lawyers Association of Northern California (BWLNC) sets as its mission the dual purposes of supporting black women judges, lawyers, and law students in the region and dedicating time and resources to service in the community.  Through educational programs and social gatherings, the BWLNC brings together established professionals and nascent attorneys to share experience, knowledge, and the support that means so much in any demanding profession.  The BWLNC includes amongst its current partnerships a collaboration with Rebuilding Together Oakland, which brings the community together to help repair and secure the homes of low income residents of Oakland.  For more information about the BWLNC, please visit www.bwlnc.com.

California Women Lawyers 

Standing up for women's rights in the workplace and in society is the core mission of California Women Lawyers (CWL).  Noting that the advancement of women's rights depends significantly on court decisions which solidify these rights advances, CWL actively engages in advocacy, through its own legislative agenda which pushes forward legislation to secure the rights of women in the state, and an Amicus Program which adds leverage to the cause of cases which relate to CWL's core issues.  CWL strongly believes that diversity of background and experience is essential when it comes to the appointment of new judges to the bench.  By using the law and the legislative process, CWL hopes to advance women in the legal profession and " to eliminate all inequities based on gender."  For more information, please visit www.cwl.org

ERA 
Equal Rights Advocates

San Francisco's Equal Rights Advocates (ERA) has been at the vanguard of advocacy for the rights of women and girls since 1974.  Equal access to education; safe and harassment-free environments in which to work and live; the freedom to create a family while maintaining employment and access to services - these are pillars on which ERA has built a storied history of advocacy.   

  

In 1984, ERA filed suit against the San Francisco Fire Department for discrimination against women in hiring practices, and today San Francisco boasts one of the highest percentages of women firefighters of any city in the country.  In 1997, ERA represented a female junior high school student who was sexually harassed in her Petaluma school district, without any intercession by school authorities.  The landmark case set the precedent that student to student harassment can be addressed under Title IX, which prohibits discrimination based on gender in schools which receive federal funding.  Their work on sexual harassment in education was influenced by the pioneering work of Price And Associates in two other cases: Patricia H. v. Berkeley Unified School District, et al (830 F.Supp.1288) and Nicole M. v. Martinez Unified School District (964 F.Supp. 1369).  By addressing issues that girls face in education as well as issues that women face in the workplace and in family life, ERA seeks to address inequities based on gender "throughout a life-long continuum."  For more information, please visit www.equalrights.org.

The Bar Association of San Francisco
Minority Bar Coalition 


Bringing together over 25 bar associations throughout the region, the Bar Association of San Francisco Minority Bar Coalition (MBC) exists to promote diversity in the legal profession.  By sharing resources and building bonds between organizations and members, the MBC has helped expand the opportunities for women, racial and ethnic minority, LGBT, and disabled attorneys.  After a 1987 study commissioned by the University of California found "profound disadvantages" within the legal workplace, the MBC established "Goals and Timetables for Minority Hiring and Advancement," a program whose goals have been voluntarily adopted by more than 100 Bay Area legal employers.  The organization includes the No Glass Ceiling Task Force, which seeks to increase the opportunities for women to advance to positions of leadership in the Bay Area legal world.  For more information, please visit  www.sfbar.org/mbc/index.aspx.

Allensworth Descendants' Association

On Saturday, February 25th, the Allensworth Descendants' Association presented its First Annual Black History Month Celebration in Honor of Lt. Col. Allen Allensworth, at EBGB  - The Wine Bar, in West Oakland.  The Allensworth Descendants' Association honors the memory of Lt. Col. and Rev. Allen Allensworth, founder of Allensworth, CA.  

  

The event, to benefit Prescott Elementary School, featured an entertaining and poignant presentation by Association Founder Charles Allensworth, who related the difficulties Lt. Col. Allensworth faced in his own time and his ability to nevertheless live a life of "integrity, honor, and usefulness," as his own Mother had taught him.  By being aware of those before us, Charles offered, we care more about ourselves, and thus care more for one another.  In honoring the connection to the past, the Allensworth Descendants' Association exemplifies the reality that understanding our past helps us navigate our future.

 
           
CASE HIGHLIGHTS

Freitag v. CA Department of Corrections 

 

In 2000, Deanna Freitag had had enough.  A career Correctional Officer with the State of California assigned to Pelican Bay State Prison, Officer Freitag, like other female Correctional Officers, had too long endured sexual harassment by prison inmates and the unwillingness of the California Department of Corrections (CDC) to do anything about it.  Prison inmates would routinely engage in exhibitionist masturbation in front of the female officers, in order to undermine their authority.  The open display of genitals was often accompanied by threats of violence or sexual assault against the officer.  Officer Freitag complained to her superiors, but instead of being supported, and the situation being remedied, she was retaliated against and ultimately fired.

Price And Associates sued CDC in 2000 on behalf of Officer Freitag for sexual harassment and retaliation.  Her day in Court came in April 2003, when after a month-long trial, a unanimous jury found that she (and other female officers) indeed suffered a sexually hostile work environment at Pelican Bay and she was retaliated against when she complained about it.  The jury awarded $603,000 to Officer Freitag and punitive damages against Warden Robert Ayers and two Associate Wardens, Teresa Schwartz and Augie Lopez.

The verdict provided vindication for Officer Freitag, that her very difficult journey seeking non-discriminatory treatment and justice within both the hostile job environment and the legal system, was a worthwhile journey.  But that journey had a positive impact reaching much farther than Officer Freitag alone.  After the trial, Price And Associates joined by the Law Offices of John L. Burris asked Federal Judge Thelton Henderson to order CDC to make changes to prevent sexual harassment and protect female officers from retaliation for making complaints about it.  In August 2003, Judge Henderson issued an Order appointing a Special Master to develop a Remedial Plan.  In July 2004, Judge Henderson adopted the Freitag Remedial Plan for Pelican Bay State Prison.

CDC appealed the verdict first to the Ninth Circuit Court of Appeal, and then the United States Supreme Court.  CDC lost.  The journey was long and arduous, but Deanna Freitag's struggle was the struggle of women correctional officers throughout the state, and her victory is their victory.  Officer Freitag did not set out to be a hero, yet she became one through her courage, perseverance, and the conviction that fighting for what is right is a worthwhile fight.  Her story reminds us that individuals can and do make a difference, and that seeking justice is as much about the decision to stand up, as it is about the hope and belief that justice can be achieved.

 Friends Foundation International

Friends Foundation International (FFI) grew out of a bond of friendship.  In 1975, at the University of California, Santa Cruz, a group of friends formed the organization whose purpose "is about strengthening friendship through giving and fortifying fellowship through activism."  Formally established in 1991, FFI has now surpassed twenty years of marshaling their collective resources and their collective good will to support organizations at home and abroad which advance human rights, protect the environment, and elevate the human spirit.  Attorney Price has been on the Board since 1999.

FFI's objective is to "provide support to projects or organizations otherwise unable to obtain funding from traditional sources."  Many organizations seek and receive funds from many creditable foundations which support good works, but FFI seeks to fund organizations that cannot access the normal channels of funding.  FFI functions with no overhead, benefiting from the time and resources of members and supporters.  Founder and Attorney Michael Freund provides administrative and management services for free.
