This month's issue focuses on foster care in our community. As an obstinate and impetuous 13-year-old "revolutionary," I got a good taste of Ohio's foster care system (and its juvenile justice system)!! While my own family could only cry and pray, three angels stepped in and refused to allow me to destroy my life.
Had it not been for Alice Aaron, Amy Jenkins and Lorena O'Donnell, who knows where I would be. They decided to use an imperfect system to save a child. This month we honor those who have accepted that same challenge in our community - to use an imperfect system to save a child. They may not be able to do it all, or even as much as they like, but for foster kids, a little bit of love goes a long way!! This Christmas, remember to give love to those who need it the most - reach out your hand to let foster children know that there is love in the world for them too!!

Advocating for Foster Children
The holiday season asks us to slow down for a moment in time, to reflect on the year past and what is important in life: family, friends, good health. We recognize that at the end of our busy professional days, we seek respite and comfort with our loved ones. In Alameda County, as throughout the nation, foster children face the challenge of establishing loving connections and the comfort that comes with stability. This holiday season we highlight those who work to give youngsters in foster care a foundation for health and success in the long term.
Alameda County Superior Court Judge Trina Thompson has served the needs of foster children for years. Born and raised in the Bay Area, a graduate of UC Berkeley Boalt School of Law, Judge Thompson's private practice included handling cases involving juvenile dependency in adoptions and guardianship. In 2001, she was appointed a Juvenile Court Commissioner, hearing juvenile delinquency and dependency matters. The following year, she was elected to the Alameda County Superior Court, the first African-American woman judge ever elected in Alameda County. In 2010, she was appointed Presiding Judge of the Juvenile Court, addressing the issues of juveniles, both those in need of safety and those who find themselves on the wrong side of the law.
 | Judge Trina Thompson |
Judge Thompson has consistently reached out to and worked in the community to address the needs of foster children. She has chaired the Alameda County Educational Task Force, whose purpose was to ensure the education of state-raised children. She recognizes that it is a continuum of services, from the Court through County Social Services through organizations in the community, which supports foster children as they establish a stable situation in which to create their lives.
President Obama recognized her work this past June, when he appointed Judge Thompson to the Coordinating Council on Juvenile Justice and Delinquency Prevention, an independent council in the executive branch which coordinates federal initiatives to care for at-risk juveniles. We applaud Judge Thompson for her instrumental work in, as she says, "providing permanency and stability for our youth through constant and stable" care.

Davis v. Prison Health Services and the Alameda County Sheriff's Department
We are thrilled to announce that last Thursday, December 15, 2011, a jury decided in favor of our client, Freddye Davis, in her retaliation case against the Alameda County Sheriff's Department (Davis v. Prison Health Services and Alameda County Sheriff's Department, United States District Court Case No. C09-02629 SI). The jury found Captain James E. Ayala liable for retaliation against Ms. Davis, and awarded her $528,957.00.
Freddye Davis has lived a life dedicated to the advancement of civil rights and to fairness and equality for all people. From her youth in Birmingham, Alabama marching with Rev. Dr. Martin Luther King, Jr., to her current tenure as the head of the Hayward branch of the NAACP, Ms. Davis has advocated for the rights of those who have been underserved and underheard. It is for this advocacy that Ms. Davis found herself in Court.

Ms. Davis worked more than 15 years as a nurse for Prison Health Services (PHS) at the Santa Rita Jail in Dublin where she received consistently positive performance reviews. In 2006, a group of nurses spoke out about the mistreatment they were receiving from a PHS manager. Defendant Ayala threatened to revoke their security clearances in retaliation for their protest, which meant that they would lose their jobs. Ms. Davis spoke out on behalf of the nurses stating that Defendant Ayala could not threaten them, and that proper procedures must be followed. In retaliation, Ms. Davis was harassed and forced out of her job.Outside of her employment, Ms. Davis is a true civil rights icon. In 2006, she was inducted into the Alameda County Women's Hall of Fame for her community service work. That same year, she was honored by the California State Legislature as the 18th Assembly District's "Woman of the Year." She is known for her selfless assistance to others and her willingness to work hard to make California a better place to live. Her advocacy on behalf of her fellow nurses was another example of her courage and tenacious defense of the constitutional rights of all citizens. Ms. Davis credits Dr. King for teaching her the importance of the Constitution for all people.
Ms. Davis and the jury spoke truth to power. Pamela was pleased to work with our Associate Terina M. Williams and co-counsel on the case, Attorneys Fania Davis of Oakland and Darryl Parker of Bellevue, Washington.

First Place for Youth

First Place for Youth is oriented to help foster youth "make a successful transition to self-sufficiency and adulthood." Located in downtown Oakland, the 13-year-old organization focuses first on assisting youth who are aged out of foster care with stable housing. One of the helpful features of the program is that support is provided in a graduated way - for instance, a young person will receive a full month's rent for the first month, and then that amount will be decreased over time, to help the individual learn self-sufficiency. Education and health services are also important parts of the support provided. To learn more, please visit www.firstplaceforyouth.org.
Bay Area Youth Connection
Hayward's Bay Area Youth Connection strives to make the foster youth they serve key partners in the organization's work. From developing policies to choosing activities, the youngsters are included in the decision making process. Nerissa James-Lopez is a young lady who benefitted from the support she found at Bay Area Youth Connection. She enthusiastically credits the organization for "striving to help make each youngster's life a little better," giving the youth "a deeper connection" that makes them each genuinely feel that they can improve their lives.
Nerissa is a true success story, and has gone on to assist those in need in her own work. As a Navigator for the Alameda County District Attorney's Office Victim & Witness Assistance Division, she helps victims of crimes navigate the justice system by connecting them with the support and services they need.
